RESOLUTION NO. 6171
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL ORDERING THE ARNTZ
OPEN SPACE ANNEXATION PURSUANT TO THE
MUNICIPAL ORGANIZATION ACT OF 1977
WHEREAS, The City Council of the City of San Rafael by
Resolution No. 6102 adopted May 18, 1981, initiated preliminary
proceedings for the Arntz Open Space Annexation and applied to the
Local Agency Formation Commission of Marin County for determina-
tions thereon, and
WHEREAS, LAFCO by Resolution No. 81-20 adopted July 30,
1981, made determinations in approving said annexation.
NOW, THEREFORE, BE IT RESOLVED:
Section 1. This annexation has been proposed pursuant
to, and is in compliance with, provisions of the Municipal Organ-
ization Act of 1977:
a. The territory to be annexed has been designated as
"Arntz Open Space Annexation," and its boundaries are as set forth
in Exhibit A, and attached legal description.
b. The territory is uninhabited.
C. The territory is being annexed to eliminate the
obligation of the City to pay property taxes on subject parcel.
d. The resolution of application was accompanied by
a plan for providing services.
Section 2. The Local Agency Formation Commission of
Marin County has made the following determinations in approving the
said annexation:
a. The boundaries of the territory proposed to be
annexed shall be those set forth in Exhibit A, and said territory
shall be designated as the Arntz Open Space Annexation.
b. Said territory is found to be uninhabited.
C. The project is Categorically Exempt pursuant to pro-
visions of the California Environmental Quality Act and the Com-
mission's Environmental Guidelines.

d. The City of San Rafael is the appropriate conducting
authority to direct complete annexation proceedings and is authorized
to proceed without notice, hearing, or election pursuant to Govern-
ment Code Section 35151, as there is written consent of all owners
of land within said territory.
Section 3. The City Council of the City of San Rafael
hereby approves and states its intention to proceed with the
Arntz Open Space Annexation.
Section 4. The Clerk of the City Council of the City
of San Rafael is hereby authorized and directed to file a certified
copy of this resolution with the Executive Officer of the Local
Agency Formation Commission of the County of Marin.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the Council of said City
on Tuesday, the 8th day of September, 1981, by the following vote,
to wit:

in the County of Marin
DESCRIPTION
LAFCO No.
All that real property situate in the County of Marin, State of California,
and consisting of the Lands of the City of San Rafael as recorded in Buok 3659
at Page 639 of Marin County Records and a portion of Ridge Avenue as shown on
the "Map of Bayside Acres Subdivision No. 2" recorded in Book 4 of Record Maps
at Page 61 of Marin County Records and more particularly described as follows:
Beginning at the Northeast corner of Lot 4 as shown on the "Map of Bayside
Acres Subdivision No. 2" recorded in Book 4 of Record Maps at Page 61, Marin
County Records, said point being on the southerly line of Ridge Avenue as
shown on above Map of Bayside Acres, said point lying also on the existing
Corporate Limits of the City of San Rafael, said point being on the westerly
line of Lot 5 as shown on the "Map of Bayside Glen Subdivision" recorded in
Book 17 of Record Maps at Page 13, Marin County Records and being thereon
South 9°23'02" East,1.5 feet from the Northwesterly corner of said Lot 5.
Thence from said point of beginning and along the common boundary between
aforementioned Lot 4 (4 R.M. 61) and said Lot 5, South 9°23'02" East, 237.0
feet to the Northwest corner of Lot 4 as shown on the "Map of Bayside Glen
Subdivision" ( 17 R.M. 13); thence alon the common boundary between said
Lot 4 (17 R.M. 13) and Lot 4 (4 R.M. 61� South 9°23'02" East, 109.0 feet;
thence leaving said common boundary South 51°18'58" West, 289.92 feet to a
point on the Westerly boundary of said Lot 4 (4 R.M. 61), said point being
on the existing Corporate Limits line of the City of San Rafael as described
by Ordinance No. 744, "Enemark Annexation", as adopted April 19, 1962, by the
City Council of the City of San Rafael; thence Northerly along said Limits
Line to a point on the Center Line of aforementioned Ridge Avenue, said
point being on a course as des;:ribed by Ordinance No. 620, "McNear Ranch
Annexation", as adopted October 3, 1955, by said City Council; thence Easterly
along the Corporate Limits to the point of beginning.
Containing approximately 2.11 acres.
