RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
STATING ITS FINDINGS AND CONCLUSIONS REGARDING
REQUEST FOR PARKING VARIANCE AND CLOSURE OF FIRE DOOR
AT THE LINCOLN HOTEL
WHEREAS, the owners and representatives of the Lincoln Hotel
and adjacent properties submitted a request for a variance from the
parking ordinance and from the building code; and
WHEREAS, this matter was presented to the San Rafael Planning
Commission; and
WHEREAS, the San Rafael Planning Commission voted to deny the
request by unanimous vote; and
WHEREAS, the owners and representatives of this property
appealed the matter to the San Rafael City Council; and
WHEREAS, a public hearing was held on March 19, 1979; and
WHEREAS, the San Rafael City Council found that the request for
a variance from the parking ordinance was not justified in that
the properties were within the downtown parking district and
received a parking concession for the first floor use and that a
variance was unnecessary in that the three different properties had
a total grandfather allowance of 47 parking spaces; and
WHEREAS, the San Rafael City Council found that opening of the
fire door would create a situation that was detrimental to the
health, safety, and welfare of the businesses and customers within
the subject properties.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City
Council formally denies the request for a variance and determines
that:
1. No future parking will be required for the first floor
and that it is within the downtown parking district;
2. The grandfathered parking spaces which total 47 and
shall be allocated in the following manner: 801 Fourth
Street - 28 spaces; 807 Fourth Street - 4 spaces; 811-817
Fourth Street - 15 spaces; and that the grandfathered
parking spaces shall be assigned to their respective property
and shall not be interchangeable between properties; and

BE IT FURTHER RESOLVED that the request to open the fire
door between two adjoining properties is hereby denied.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the City
Council of said City held on Monday the second day of
April
