A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DENYING REZONING, USE PERMITS, VARIANCE, ENVIRONMENTAL
AND DESIGN REVIEW, AND SIGN REVIEW FOR LUCKY STORES (GEMCO)
WHEREAS, the San Rafael Planning Commission held a Public
Hearing on May 22, 1979, to review z79-9, UP77-95, UP79-17, V77-24,
ED77-123, and SR78-09, filed by Lucky Stores (Gemco) requesting that
said permits be approved and granted; and
WHEREAS, the site plan and entire proposal for development
has been reviewed by the Planning Department Staff and found not to
be in conformance with all Zoning Ordinance and City Code require-
ments in all respects; and
WHEREAS, the Planning Commission in denying said permit
applications made the following findings:
Numerous and extensive street and highway improvements
would be necessary to mitigate the traffic effects of both Gemco
and full build -out of East San Rafael. The Gemco project would
occupy a small portion of the land area which has yet to be developed
in East San Rafael. However, Gemco would contribute 18.4% of the new
peak hour traffic generation of the East San Rafael study area and,
therefore, disproportionately contribute to future traffic problems.
Although the potential exists to mitigate the traffic effects, there
does not exist a budget and program which would provide for the miti-
gation measures, and some of the necessary mitigation measures appear
impractical. As a result, the Gemco proposal constitutes an inappro-
priate land use; and
WHEREAS, following a public hearing held July 2, 1979, the
City Council hereby incorporates all staff reports and other documents
and data pertaining to the permit applications herein and do incor-
porate the findings of the Planning Commission adopted in Resolution
79-11 on May 29, 1979:
NOW, THEREFORE, BE IT RESOLVED that z79-9, UP77-95, UP79-17,
V77-24, ED77-123, and SR78-09 be denied.
