HomeMy WebLinkAboutResolution No. 5775 (Short Elementary School Use for Day Care)RESOLUTION N0.5775 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a contract, lease or agreement with SAN RAFAEL SCHOOL DISTRICT REGARDING USAGE OF SHORT ELEMENTARY SCHOOL FOR A DAY CARE CENTER a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted ata —regular meeting of the City Council of said City held on Monday the 1st day of October , 19 79 by the following vote, to wit: AYES: COUNCILMEMBERS: Breiner, Jensen, Miskimen, Nixon and Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None JEANNE M. BUCHANAN, Deputy City Clerk 0. :PQ- _1'I L "1-7s A G R E E M E N T THIS AGREEMENT, entered into this lst day of September , 1979 by and between the SAN RAFAEL SCHOOL DISTRICT, hereinafter referred to as "DISTRICT", and the SAN RAFAEL RECREATION DEPARTMENT, hereinafter referred to as "RECREATION". WITNESSETH: WHEREAS, District is the owner of certain property known as SHORT ELEMENTARY SCHOOL; and WHEREAS, Recreation is desirous of making use of a portion of these facilities, pursuant to Government Code Section 40040; NOW, THEREFORE, BE IT HEREBY AGREED AS FOLLOWS: 1. District shall permit Recreation to use the Kindergarten and Room 8 Short School for a Day Care Center. 2. Said use shall be from September 1, 1979 to September 1, 1980, Monday to Friday, from 11: 0 A.M. to 6:15 P.M. 3. Recreation shall pay cost of custodial services on said facilities. District will furnish light, heat and general maintenance. 4. Playgrounds and parking areas are to be used jointly by Recreation, other school district functions and the community. 5. No structural changes shall be made by Recreation without written approval of the District. Property shall be returned to the Distric'-- in the same condition as prior to this Agreement. 6. recreation shall pay to District, the sum of $200.00 per month, payable on the first day of each month. 7. District shall continue to carry fire and liability insurance on the premises. 8. Recreation shall indemnify, defend and hold District harmless from any liability for personal injury or property damage arising out of the use of these facilities by Recreation. Recreation shall provide District with proof of insurance coverage in the amount of $500,000 for Single Occurrence; $500,000 Aggregate; and, $500,000 Property Damage, naming District as an additional insured. Fifteen (15) days notice of cancellation of said insurance shall be provided to Distric 9. This Agreement may be terminated upon 30 days written notice by either party.
