HomeMy WebLinkAboutResolution No. 5787 (Grant Deed SRSD Francisco Blvd Pump Station)RESOLUTION NO. 5787 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE SIGNING OF A GRANT DEED TO THE SAN RAFAEL SANITATION DISTRICT PROVIDING FOR THE CONVEYANCE OF CITY PROPERTY (PUMP STATION SITE AND APPURTENANCES, FRANCISCO BOULEVARD CUL-DE-SAC) TO THE SAN RAFAEL SANITATION DISTRICT WHEREAS, the City of San Rafael, a municipal corporation, herein- after referred to as "City", and the San Rafael Sanitation District, a duly organized and existing Sanitation District under the laws of the State of California, hereinafter referred to as "District", on October 15, 1969, entered into a certain Joint Powers Agreement regarding their respective rights and obligations relating to the acquisition, construction, mainten- ance and operation of a sewage collection treatment and disposal system within their respective areas; and WHEREAS, said Joint Powers Agreement provided that the City would acquire certain real property and deed the same to District; and WHEREAS, City has noaacquired said property by relinquishment from the State of California and the public interest and convenience requires the conveyance of said real property to the District; and WHEREAS, City has passed Ordinance No. 1000 providing for the conveyance of said property to District. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HERE- BY RESOLVES AS FOLLOWS: The Mayor and City Clerk are authorized and directed to execute and deliver a deed in the name of the City of San Rafael to the San Rafael Sanitation District to carry out the terms and conditions of said Joint Powers Agreement and Ordinance No. 1000; a copy of said deed is attached hereto, marked Exhibit "A", and incorporated herein by this refErence. I, JEANNE M. DESCRIPTION ALL THAT CERTAIN real property situate in the City of San Rafael, County of Marin, State of California, described below as follows: A Cul-de-sac (Francisco Blvd.), lying on the general Northeasterly side of the main traveled ways of State Freeway, Road 04-Mrn-101, described as follows: BEGINNING at a point on the _general Northeasterly right of way line of said Freeway, said point being the Northeasterly corner of that certain parcel of land described in Deed No. 30314 to the State of California, recorded July 17, 1964, in Volume 1837, page 423, Official Records of Marin County; thence along said general North- easterly right of way line, South 13°19'40" West, 86.41 feet, along a tangent curve to the left with a radius of 40.00 feet, thr$ugh an angle of 61°55'58", an arc length of 43.24 feet and South 48 36'18" East, 13.99 feet; thence South 41°23'42" West, 46.00 feet; thence from a tangent that bears North 48°36'18" West, along a curve to the right with a radius of 500.00 feet, through an angle of 29°36'07", an arc length of 258.33 feet to said general Northeasterly right of way line; thence along last said line, South 75°03'56" East, 175.42 feet to the point of beginning. THE bearings and distances used in the above description are on the California Coordinate System, Zone 3. Multiply the above distances by 1.0000607 to obtain ground level distances. EXCEPTING AND RESERVING to the State of California any and all rights of ingress to and egress from the above described property in and to the adjacent and adjoining freeway lying southwesterly of said parcel, except at such points as now are or may be established by resolution of this Commission. ALSO EXCEPTING AND RESERVING THEREFROM an easement to the City of San Rafael over the above described property for street and public utility purposes and for maintenance of any and all facilities of said City, including but not limited to, the street, pedestrian walkway, storm water pump station, appurtenant drainage facilities, gravity sanitary sewer facilities, landscaping and the San Rafael Canal. ALSO EXCEPTING any portion of the above described property lying within the bed of the Sari Rafael Canal below the line of natural ordinary high tide and also excepting any artificial accretions to said land waterward of said line of natural ordinary high tide.
