A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of the
City of San Rafael a contract, lease or agreement with
JOINT POWERS AGREEMENT BETWEEN CITY OF SAN RAFAEL AND
MARINWOOD COMMUNITY SERVICES DISTRICT
a copy of which is hereby attached and by this reference made a part hereof.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a REGULAR meeting of the City Council of said City held on

JOINT POWERS AGREEMENT
THIS AGREEMENT, made and entered into this fifth day of November ,
1979, by and between MARINWOOD COMMUNITY SERVICES DISTRICT, hereinafter referred
to as "DISTRICT", and the CITY OF SAN RAFAEL, a municipal corporation, hereinafter
referred to as "CITY"
W I T N E S S E T H
WHEREAS, Title 1, Division 7, Chapter 5 of the California Government Code
provides for joint powers agreements between public bodies; and
WHEREAS, it is in the mutual interests of the parties hereto to enter
into an agreement to provide for the mutual fire protection of certain areas of
this City and of the District;
NOW, THEREFORE, in consideration of the mutual promises and covenants
hereinafter contained, the parties hereby agree as follows:
CITY agrees to:
1. Dispatch on a first alarm one (1) engine, truck or squad company to
the District within City's capabilities of available manpower and equipment as
illustrated in Exhibit "A" attached hereto. The District shall be understood to
encompass the area included within County Service Area 13 as well as Marinwood
Community Services District.
2. Provide the District with twenty four (24) hour dispatching, for the
receipt and retransmission of emergency alarms only.
3. Respond with its available equipment to all emergencies occurring
within the District while the District is engaged in emergency operations within
the City, or second alarms occurring within the District as per this Agreement.
4. Provide on request a chief officer to the District to assume the
position of Incident Commander should the District Chief be unavailable.
DISTRICT agrees to:
1. Dispatch on a first alarm one (1) engine or squad company to the
City within the District's capabilities of available manpower and equipment as
illustrated in Exhibit "A" attached hereto.
2. Provide the City with emergency back-up communications utilizing
existing facilities at the District fire station.
3. Respond one engine to second alarm fires within the City, generally
occurring in the northern portion of the City, north of Puerto Suello Hill as
illustrated in Exhibit "A", attached hereto.
4. Provide a chief officer, if available, to assist in coordination
between the District and the City when District apparatus is engaged in emergency
operations within the City, as illustrated in Exhibit "A", attached hereto.

IT IS FURTI AGREED:
1. District and City will participate jointly on a monthly basis in a
training program at a time and place to be designated by the Chiefs of the
District and the City.
2. In cases where the District utilizes the training facilities at
San Rafael Station #2, the City will provide an engine and personnel complement
for the District while the District's personnel are absent from their station.
3. The City hereby holds the District, its officers, agents, servants
and employees, while acting within the course and scope of their employment, free
and harmless from any liability from any obligations arising by virtue of law,
because of injury to property or injury or death of persons received or suffered
by reason of any actions of the City under the provisions of this Agreement.
4. District holds City, its officers, agents, servants and employees,
while acting within the course and scope of their employment, free and harmless

actions of the District under the provisions of this Agreement.
5. This Agreement may be amended or terminated by the mutual consent
of the parties hereto and may be cancelled by either party upon ninety (90)
days; notice in writing.
IN WITNESS WHEREOF, the parties have executed this Joint Powers
Agreement this 5th day of November , 1979.
