HomeMy WebLinkAboutResolution No. 5402RESOLUTION NO. 5402 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CONCERNING PRESERVATION OF THE RESIDENTIAL NEIGHBORHOOD WHICH GENERALLY LIES IN THE AREA FROM THE SOUTH SIDE OF BELLE TO AND INCLUDING THE EAST SIDE OF GRAND, THE NORTH SIDE OF MISSION TO MARY STREET, WEST SIDE OF MARY TO FOURTH, TO IRWIN AND NORTH TO BELLE; EXCLUDING THOSE LOTS AND STRUCTURES FACING ON FOURTH OR ON IRWIN. WHEREAS, the area generally described above and more explicitly identified on the attached Assessor's Parcel map is primarily residential in characteristics; and WHEREAS, that area is among the few residential areas in San Rafael having a remaining capacity to provide moderate cost housing; and WHEREAS, the General Plan of San Rafael states that "San Rafael has been suffering a continuing short supply of housing and an upward trend of housing price for units from moderate income families than is true of the larger market area .... this and other data show that the number of would be residents unable to afford the rent or purchase price of housing here greatly increased during the last decade. At the same time the stock of older housing in San Rafael - which is the chief housing resource for such individuals - is being constantly eroded...."; and WHEREAS, Policy #2 of the Housing Element of the San Rafael General Plan states that the City shall "emphasize the conservation and rehabilitation of the viable older housing stock in the City in order to preserve neighborhood character, and where economically feasible, retain a supply of low and moderate income units."; and WHEREAS, the General Plan in its implementation states the City should "support programs to permit existing residents on fixed incomes to continue living within the Planning Area and to provide housing for low and moderate income families"; and WHEREAS, the Government Code of the State of California in Section 65860(a) specifies that "City zoning ordinances shall be consistent with the General Plan of the City"; and that "a zoning ordinance shall be consistent ... only if the various land uses authorized by the ordinance are compatible with the objectives, policies, general land uses and programs specified in such a plan"; and WHEREAS, the Planning Commission, in the Fall of 1975 in evaluating an appli- cation for an office building on the southeast corner of the intersection of Fifth Avenue and Irwin Street, determined that was an area of viable moderate income housing which was continuing to experience maintenance and upgrading of its housing character- istics and should be further preserved; and that the proposed office building facing onto Irwin Street would serve as such a buffer and further protect the residential integrity of the neighborhood; and WHEREAS, the Planning Commission in September 1977, denied a use permit for the conversion of a residence on Mission Avenue adjacent to Irwin Street into an accounting office and again in November of the same year, denied a further application for conversion of that same residence into an office on the basis of the stated purpose of preserving the residential character of that neighborhood; and WHEREAS, the Planning Department continues to receive a number of inquiries concerning conversion of residences to office and other nonresidential purposes within this general area; and WHEREAS, the Planning Commission at its regular meeting of January 10, 1978, recommended favorably to the City Council the preservation of this residential neighbor- hood against intrusion of nonresidential uses by adoption of Resolution No. 78-1. NOW THEREFORE BE IT RESOLVED by the San Rafael City Council that in order for zoning actions to be consistent with and to carry out the intent of the San Rafael General Plan of preserving viable older housing stock for moderate and lower income housing, it is necessary to disapprove applications for nonresidential uses within the area so described on the finding that such use in this area would diminish such housing stock and would be inconsistent with the Goals of the Housing Element of the San Rafael General Plan and therefore, not be in accordance with the laws of the State of California. 1, JEANNE M.
