A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ACCEPTING A GRANT OF RIGHT-OF-WAY EASEMENT FOR ACCESS PURPOSES,
THIRD AND 'B' STREETS PARKING LOT, SAN RAFAEL, CALIFORNIA
WHEREAS, public interest, convenience and welfare require
that the easement hereinafter mentioned be accepted and used for
the benefit of the public of the City of San Rafael, California;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of San Rafael, California, that that certain grant of
right-of-way for access purposes across City's parking lot on
Third Street between 'A' and 'B' Streets, executed by S. K. Herzog
Company, a partnership, to the City of San Rafael, dated April 11,
1978, be, and the same is hereby, accepted and the Clerk of said
City is hereby directed to cause said conveyance to be duly recorded
in the office of the County Recorder of the County of Marin, State
of California, forthwith upon the adoption of this resolution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of
the City Council of said City held on the 17th day of April ,
1978, by the following vote, to wit:

A right-of-way over, along, and across the land described as follows:
A strip of land 10' in width; parallel to, adjacent to, and lying to the
west of a line described as follows:
Beginning at the most southeasterly corner of Parcel "A" as described
in the deed recorded April 23, 1965 in Book 1933 on page 78 of the
Official Records of the County Recorder of Marin County, thence northerly,
parallel to "B" Street and along the easterly boundary of said property,
27'+ to a point which lies 20' southerly of the northern boundary of
said parcel.
The granting of the above mentioned right-of-way will be in consideration
of the City of San Rafael agreeing as follows:
1. To pave the balance of the 10 foot strip northerly of the
subject property an additional 20 feet.
2. To pave and also to maintain the asphalt surface of the subject
property as well as paving and also maintaining the asphalt surface
of the remaining portion of the "strip" to Third Street. This
latter strip is 103 by 10 feet and is shown as Parcel Three on the
attached description.
