A RESOLUTION AUTHORIZING THE PURCHASE
OF 522 "B" STREET. (A. P. 13-061-40)
The City of San Rafael hereinafter referred to as City, having
duly noticed and having held a public hearing, does hereby declare,
find and determine that:
1. WHEREAS, it is the policy of the City to provide a full
range of park and recreation activities to its residents; and
2. WHEREAS, the property at 522 "B" Street, (A.P. 13-061-40)
as described in Exhibit "A" attached hereto, is available for pur-
chase by the City; and
3. WHEREAS, this property will provide for the orderly expan-
sion and development of Albert Park; and
4. WHEREAS, the City will utilize funds from various sources
for this purchase, including the 1976 State Parks Bond Act, the
Roberti-Z'Berg Act, the 1974 State Parks Bond Act, the Housing and
Community Development Act, and the Capital Improvements Fund of the
City; and
5. WHEREAS, the City and Agency have made a reading file avail-
able to the public at the office of the City Clerk, 1400 Fifth Avenue,
San Rafael, and the Agency office at 1313 Fifth Avenue, San Rafael
in conformance with Section 33433 of the California Health and Safety
Code, and aforesaid section further requires that the sale or lease
of any Agency acquired property which was purchased in whole or part
with tax increment monies, must first be approved by the legislative
body after a public hearing; and
6. WHEREAS, two legal notices of this public hearing were
placed a week apart in a newspaper of general circulation within
the City of San Rafael, the first publication being not less than
two weeks prior to the date of the meeting said intention is to be
acted upon; and
7. WHEREAS, the City finds that the purchase price of One Hun-
dred Fifty -Seven Thousand, Five Hundred Dollars ($157,500) is not
less than an independent appraisal of the fair market value of the
property for the highest and best use of the property consistent
under the Plan; and
8. WHEREAS, City staff has conducted an environmental review
by contacting the San Rafael Redevelopment Agency and other depart-
ments, staff recommends this project be determined to be categoric-
ally exempt under California Administrative Code Title XIV, Section

15112, Class 12 Surplus Government Property Sales.
NOW, THEREFORE, the City takes the following
ACTION:
RESOLVED, the City, the legislative body, acknowledges the
Joint Public Meeting with the San Rafael Redevelopment Agency, in
compliance with Health and Safety Code Section 33433 and approves
of the sale as proposed; further
RESOLVED, the City finds and determines the project is cate-
gorically exempt from the California Environmental Quality Act of
1970, as amended; further
RESOLVED, the Mayor, in the name of the City of San Rafael,
is authorized to purchase the property at 522 "B" Street,
(A.P. 13-061-40) as described in Exhibit "A" attached hereto,
for the sum of One Hundred Fifty -Seven Thousand, Five Hundred Dol-
lars ($157,500) and sign all necessary papers to complete the pur-
chase thereof.
I, JEANNE M. LEONCINI, City Clerk for the City of San Rafael
hereby certify that the foregoing resolution was duly and regularly
introduced at a special joint meeting of the members of said Council held
on the 7th day of August , 1978, by the following vote to wit:
