HomeMy WebLinkAboutResolution No. 5556RESOLUTION NO. 5556 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ORDERING THE ANNEXATION OF THE TERRITORY DESIGNATED AS "SUN VALLEY SCHOOL SITE ANNEXATION" (75 HAPPY LANE) TO THE CITY OF SAN RAFAEL (Uninhabited) WHEREAS, the City of San Rafael adopted Resolution No. 5510, making application to the Marin Local Agency Formation Commission for annexation of uninhabited territory; and WHEREAS, the Marin Local Agency Formation Commission, by Resolution No. 78-25, adopted on September 14, 1978, approved said annexation and desig- nated the City of San Rafael as the conducting agency for further proceedings; and WHEREAS, this application was accompanied by written consent signed by all owners of land within the territory proposed for annexation and the Local Agency Formation Commission authorized the conducting agency to complete further proceedings withtwaiver of notice, hearing and election requirements; and WHEREAS, said annexation, known as the Sun Valley School Site Annexation, consists of prezoning from County A -2:B-2 District to City of San Rafael R-1 District. WHEREAS, the subject territory which is uninhabited is located in the County of Marin is more specifically described in the map and legal description attached to this resolution; NOW, THEREFORE, BE IT RESOLVED by the San Rafael City Council that: Section 1. This proposal is hereby approved subject to the following terms and conditions: That the annexation territory shall be withdrawn from County Service Area No. 19 pursuant to Section 25210.90 of the Government Code which provides that territory in a county service area which is included within a city by reason of annexation shall be automatically excluded from the county service area upon the effective date of its inclusion in the City. Section 2. The annexation is proposed for the following purposes: Obtain municipal services for which property owner is presently ineligible. The Clerk of the City of San Rafael is hereby directed to file a certified copy of this resolution with the Executive Officer of the Local Agency Formation Com- mission of the County of Marin. LE ON CINI , City Clerk ©- EXHIBIT "A" JULY 10, 1978 "SUN VALLEY SCHOOL SITE" Annexation to the City of San Rafael No. -28-78 DESCRIPTION That parcel of land situated in the County of Marin known as Assessor's Parcel 177-240-12, together with a portion of right-of-way, more particularly described as follows: Beginning at a point on the Northeasterly line of the Lands of the San Rafael School District, said point being at the juncture of calls North 37° 04' East, 433.73 feet and North 51° 25' West, 270.368 feet as described in Volume 702 at Page 170 of Official Records, said point being also a point on the existing San Rafael City Limits; thence from said point of beginning North 51° 25' West, 270.368 feet; thence South 43° 01' West 448.443 feet to the Northeasterly line of Fifth Avenue; thence South 52° 26' West, 35 feet to the center line of Fifth Avenue, said center line being also the existing San Rafael City Limits; thence Southeasterly and Northeasterly along said limits line to the point of beginning. Containing approximately 3.29 acres.
