HomeMy WebLinkAboutResolution No. 5563RESOLUTION NO. 5563 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE TRAINING AGREEMENTS BETWEEN THE POLICE DEPARTMENT OF THE CITY OF SAN RAFAEL AND THE STATE OF CALIFORNIA DEPARTMENT OF HIGH- WAY PATROL WHEREAS, The State of California Department of Highway Patrol requires written training agreements from any agency par- ticipating in their training programs; and WHEREAS, the Police Department of the City of San Rafael desires from time to time to participate in certain training programs sponsored and administered by the California Department of Highway Patrol: NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael, California does hereby authorize and direct the City Manager to sign such training agreements when required. I, JEANNE M. Under no circumstances will a participant from your de- partment be accepted if there is not a signed agreement on file in this office. If you have questions, you may contact the Contract Unit, telephone 916/445-2706. Attached is an approved copy of the agreement which allows your department/personnel to participate in training classes conducted at the Academy. XX Also please forward a resolution from your City Council authorizing the training and the person to sign the agreement. ACCOUNTING SECTION Attachments cc: Academy/Johnston If reimbursement from POST is anticipated for attendance at this course, departments are required to collect, analyze, and maintain police vehicle accident data as well as establish accident review procedures designed to evaluate and reduce their traffic accident problems. While prior review and approval by POST is not required, departments are subject to audit. 071-91 (2/78) TRAINING AGREEMENT THIS AGREEMENT, mgde and entered into this 25th day of September , 1978, by and between the State of California, acting by and through the Department of California Highway Patrol, hereinafter called CHP, and the Cry `'y of Sail ".afael. hereinafter called the City P.D. WITNESSETH, by and in consideration of the covenants and conditions herein contained, the CHP and the City P.D. do hereby agree as follows: 1. CHP agrees to allow C'ty P.D. to attend training classes during the period(s) as follows: Allied t',ggency Dr'.ver: Trainin^ 2 trainees -- 12/11-13 2 trainees _2/27-29 2. CHP agrees to provide living, dining, and classroom facilities as required. 3. As consideration for the use of the Academy facilities, agrees to pay CHP upon receipt of an invoice in accordance with the following: Per resident student . . . . . .$ 25.00 per day Per non-resident student . . . .$ N/A per day Instruction fee . . . . . . . .$ 70.00 per 8 hour day TOTAL not to exceed. . . . . . .$ $1,140.00 4. The rates indicated in this agreement are for estimate purposes only. In the event CHP is granted a rate increase, City P.D. agrees to pay CHP at said increased rates. 5. The rates indicated in this agreement are for estimate purposes only. In the event State is granted a rate increase effective July 1, 1978, C" tY i•''• agrees to pay State at said increased rates. 6. CitJ' agrees to indemnify, defend, and save harm- less CHP, its officers, agents, and employees from any and all claims and losses accruing or resulting to any person, firm, or corporation who may be injured or damaged by the City P.D. in the performance of this agreement. 7. Cir, P.D. shall be responsible for paying any cost in- curred by CHP for facility damage caused by the willful or malicious misconduct of City P,Do trainees. 8. This agreement shall become effective when signed by both parties, and upon CHP's receipt of a resolution covering the agreement. Training shall not be authorized until the resolution is on file with CHP. 9. This agreement may be amended by mutual consent of the parties hereto. 10. Notices and communications hereunder shall be sent to the addresses appearing below the signatures.
