RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL REQUESTING DELETION OF PRIVATE PROPERTY
DREDGING ON THE LOCH LOMOND MARINA CHANNEL AND
PAGANINI COVE FROM THE FEDERAL PROJECT, AND ALSO
REQUESTING RETURN OF FUNDS ON DEPOSIT WITH THE
FEDERAL GOVERNMENT
WHEREAS, improvement of the San Rafael Canal, Marin County,
California, was authorized by the River and Harbor Act of 2 March
1919, House Document No. 801, 63rd Congress, 2nd Session; and
WHEREAS, the project was completed in 1928, with a contem-
plated scheduled maintenance program at Government expense to be
undertaken as required; and
WHEREAS, pursuant to 33 U.S.C. 560, the City has requested
the Government to perform as part of the Federal navigation mainten-
ance dredging contract certain additional side and marina dredging
at the City's expense; and
WHEREAS, the additional side and marina dredging will be
done on privately owned property at the owner's direction and ex-
pense by the Government's contractor; and
WHEREAS, the City has agreed to provide funds sufficient to
reimburse the Government for the costs of performing the side and
marina dredging plus the associated Government costs of the City's
requested dredging; and
WHEREAS, the City has agreed to assist the private property
owners in having the dredging done at the lowest cost to the property
owner and has entered into an agreement with the Federal Government
to do the dredging; and
WHEREAS, the U. S. Army Corps of Engineers opened bids on
September 7, 1977, for the San Rafael Outer Canal dredging project
which consisted of dredging the 100 -foot wide Federal channel and
the privately owned Loch Lomond Marina and Paganini Cove; and
WHEREAS, the low bidder was PETER KIEWIT SONS CO. of Rich-
mond, California, at the following prices:

Marina has now decided not to participate in the dredging project, and
the Corps of Engineers has stated the Paganini Cove work cannot be
included in the project without the Loch Lomond Marina work; and
WHEREAS, the Corps of Engineers now intends to proceed with
the project to dredge only the Federal channel; and
WHEREAS, the San Rafael Redevelopment Agency has deposited
the sum of $250,000.00 with the Corps of Engineers to reimburse the
Government for the cost of dredging the Loch Lomond Marina and
Paganini Cove;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of San Rafael that the dredging work on the Loch Lomond
channel and Paganini Cove be deleted from the Corps of Engineers'
project, at the property owners' request, and also requests that
the moneys deposited with the Federal Government by the San Rafael
Redevelopment Agency in the amount of $250,000.00 be refunded.

WHEREAS, based
on the bid
prices
received, Loch
Lomond
Marina has now decided not to participate in the dredging project, and

introduced and adopted at a REGULAR meeting of the Council of said
City on Monday, the 19th day of September, 1977, by the following
