A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL
AMENDING RESOLUTION NO. 5029 PERTAINING TO
THE COMPENSATION AND WORKING CONDITIONS FOR
FIRE DEPARTMENT PERSONNEL
BE IT RESOLVED by the City Council of the City of San Rafael as follows:
Section 1. Salaries. Effective July 1, 1976, a salary increase of three
percent (3%) shall be paid to all employees covered by this resolution and shall
be applied across the board to all classifications, steps and ranges pursuant to
Exhibit "A" attached.
Effective July 1, 1978, a salary increase shall be paid to all employees
covered by this resolution and shall be applied across the board to all classifications,
steps and ranges, equal to the increase in the Consumer Price Index, All Items,
for Urban Wage Earners and Clerical Workers (San Francisco -Oakland, California)
for the period March 31, 1977 to March 31, 1978, not to exceed five percent (5%),
however; provided, further, that if said increase results in a percentage increase
exceeding five percent (5%), one-half of such excess in addition to the five percent
(5%), shall be paid to all covered employees and applied across the board.
Section 2. Insurance Program. Effective July 1, 1977, as an added fringe
benefit, a maximum amount of Seventy -Five Dollars ($75.00) per month will be
contributed towards the cost of each eligible employee's Health, Accident, Life,
and Disability Insurance Package. Selection of coverage must include the employee's
basic health plan and $5,000 life insurance policy offered by the City.
Section 3. Dental Insurance. Effective July 1, 1976, the City will provide
and pay the premiums to have a dental insurance program carried by the California
Dental Service, Program III A, as shown in CDS proposal dated May 7, 1976, at
the premium rate quoted therein under the heading "Super -Composite." In the event
that the rate is increased at any time after July 1, 1978 but before June 30, 1979,
the City shall continue the Program and shall pay the increased rate from the date of
the increase for the term of this resolution, to the extent that said increase does not
exceed ten percent (10%); any increase exceeding that percentage shall be repaid to
City by a reduction in monthly salaries across the board in an amount equal to the
monthly increase in the premium rate, to the extent that it exceeds ten percent (100%).
Section 4. Retirement Program. Effective July 1, 1977, the City will join
the "present" system of the Employees' Retirement Association of the County of Marin
as described in the actuarial studies performed by Coates, Herfurth & England, dated
April 29, 1976 and July 1, 1975, on behalf of all employees covered by this resolution,
including both general and safety personnel, and including active and inactive
retired members, as set forth in said actuarial studies; provided, however, that
if City fails to join as of July 1, 1977, the above-mentioned "present" system of
the Marin County Employees' Retirement Association, on behalf of all the above-
mentioned employees, for whatever reason, including but not limited to the failure
to fulfill any condition precedent to the City's entry into such system, the parties
to this resolution shall reopen the process of meeting and conferring in good faith
with respect both to all matters covered by this resolution and all matters within
the scope of meeting and conferring, and all provisions of this resolution and all
matters within the scope of meeting and conferring shall be renegotiated retroactive
to July 1, 1976.
Section 5. Safety Committee. One member of the Firefighter or Fire
Engineer classification shall serve on a City-wide safety committee.
Section 6. Residency. Within one year of employment, all new employees
in those classifications represented by the Union shall have their principal place of
residence within a twenty-five (25) mile radius of Fire Station #1 of the City of
San Rafael.
Section 7. Educational Incentive. The educational incentive program now
in existence for employees of the Fire Department shall continue; provided, however,
that in the event that the Union prepares and submits to the City an educational
recertification program, and such program is adopted by the City Council, an
additional 2%/o compensation shall be granted in the two categories now provided
for in the existing educational incentive program, upon fulfilling the requirements
of the recertification program.
Section 8. Management Personnel. The positions of Fire Chief, Battalion
Chief, Fire Marshal, Training Officer, and Secretary to the Fire Chief are deemed
management positions and are to be included within the Unclassified salary schedule
for salaries and fringe benefits.
Section 9. Call -Back. There shall be a minimum of two hours call-back
pay at time -and -one-half whenever an employee in the classifications of Fire
Captain, Fire Engineer, Firefighter, Fire Prevention Inspector and Fire Engineer
Mechanic are asked to continue their work schedule past the duty day or are called
back by the Department.
Section 10. Medical Standards Ordinance. A medical standards ordinance
to be applicable to Fire Department personnel in the classifications of Firefighter,
Engineer, and Captain will be discussed by the City and the Union and will be
adopted only after mutual agreement by both parties.

Section 11 . Personnel Rules and Regulations. No changes shall be made by
the City in the Personnel Ordinance, Rules or Regulations without prior meeting
and conferring in good faith with the Union.
Section 12. This resolution shall take effect forthwith upon its adoption
and the several compensations and allowances herein provided shall be in full
force and effect as of and from July 1, 1976 through June 30, 1979.
