HomeMy WebLinkAboutResolution No. 5133RESOLUTION NO. 5133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING RESOLUTION NO. 4994 PERTAINING TO THE COMPENSATION AND WORDING CONDITIONS FOR POLICE DEPARTMENT PERSONNEL BE IT RESOLVED by the City Council of the City of San Rafael as follows: Section 1. Salaries. Effective July 1, 1976, a salary increase of three percent (3%) shall be paid to all employees covered by this resolution and shall be applied across the board to all classifications, steps, and ranges pursuant to Exhibit "A" attached. Effective July 1, 1978, a salary increase shall be paid to all employees covered by this resolution and shall be applied across the board to all classifications, steps and ranges, equal to the increase in the Consumer Price Index, All Items, for Urban Wage Earners and Clerical Workers (San Francisco -Oakland, California) for the period March 31, 1977 to March 31, 1978, not to exceed five percent (5%), however; provided, further, that if said increase results in a percentage increase exceeding five percent (5%), one-half of such excess in addition to the five percent (5%), shall be paid to all covered employees and applied across the board. Section 2. Salary Designations. The salaries herein established are monthly compensation unless otherwise specified. Section 3. The Administration of the Pay Plan. Salary advancements shall be made on the basis of the salary rates, salary ranges and salary steps set forth opposite each classification in this resolution. Before any person is advanced to the next step, a written statement must be filed by the Department Head with the City Manager recommending such increase. The steps of each salary range shall be applied as follows: The first step is the minimum rate and shall normally be the hiring rate for the class. In cases where it is difficult to secure qualified personnel, or if a person of unusual qualifications is engaged, the City Manager may hire at a higher step. The remaining steps represent the ordinary next salary steps for each year of service, providing the employee is qualified in his work to receive the next step. Anniversary date shall be interpreted as the 1st day of the month for those employees entering the service between the 1st and the 15th of the month and on the 1st day of the next month for those entering the service after the 15th of a month. The semi-monthly pay periods shall be adjusted to the 1st and 15th day of each month. Section 4. Appointments and Salaries. The City Manager, in accordance with the Personnel Rules and Regulations, may make appointments of prospective employees to a position in a class for which the salary is herein provided and designate the definite salary rate or salary step at which such person is appointed. 1 . The salary so designated is thereby fixed as the salary of such employee for such position; provided, further, that the City Manager may from time to time increase or decrease the salaries of persons so appointed in accordance with provisions of Section 1 , provided that the salary so fixed is within the ranges established for that classification. Section 5. Parttime and Temporary Employment. Employees appointed to any of the positions referred to herein and employed or working on a parttime basis shall be paid in proportion to the time worked and described in their appointment. Temporary employees may be appointed by the City Manager when authorized budget funds are available. Section 6. Additional Pay for Police Department. Police Department personnel assigned to the following duties shall receive additional compensation amounting to five percent (5%) of their basic monthly salary: (a) Police Sergeant serving as Investigative Supervisor. (b) Police Sergeant serving as Juvenile Officer. (c) Police Officer serving in Investigative Division. (d) Police Officer serving in Juvenile Division. (e) Operation of a solo -motorcycle for more than 50% of his work month. Female employees who are requested to perform the duties of Police Matron shall receive $2.50 per hour in addition to their regular hourly rate of pay for only actual time served in this capacity. Section 7. Holidays. The shift personnel in the Police Department, namely the Police Sergeant, Police Inspector, Police Officer, Radio Telephone Operator and Police Cadet, are entitled to straight time compensation for every holiday in each given year which all other City employees received as time off. Said compensation shall be paid twice each year on the first pay period of December and the first pay period of June. Section B. Overtime. All miscellaneous employees with the exception of Department Heads and supervisory personnel, who are required to work in excess of their basic work week during any one week shall be given compensatory time off at the rate of time and one-half, or, upon the recommendation of the Department Head and subject to approval of the City Manager, shall be paid at the rate of time and one-half of their established hourly rate, based on their regular monthly salary. Upon accrual of five (5) days of forty (40) hours of overtime, members of the Police Department shall be paid at the rate of time and one-half of their established hourly rate. Notification by the Officer in Charge directing that compensatory time be taken, or by the employee's requesting compensatory time off, on any specific date must be submitted not less than five (5) days in advance for the mutual agreement of both parties. 2. In addition, those members who are required in the course and scope of their official employment to appear in Court other than during their regular tour of duty or shift of hours, shall receive a minimum of two (2) hours pay at the rate of time and one-half of their established hourly rate. In the event that an employee resigns or is terminated, he shall be entitled to compensation for his accumulated overtime. For the purpose of computing overtime, the work shall be defined as beginning at 12:01 A.M. Sunday morning and ending at 12:00 midnight Saturday. Section 9. Educational Incentive Program for Safety Personnel. To increase the educational level of the employees in the Police Department and to assist in the recruitment of public safety members into the field of law enforcement, the City shall pay an educational incentive in accordance with the following: (a) Those employees possessing a Peace Officers Standards of Training Intermediate Certificate shall receive additional compensation, amounting to 5% of their basic monthly salary. (b) Those employees possessing a Peace Officers Standards of Training Advanced Certificate shall receive additional compensation, amounting to 7W. of their basic salary. To qualify for educational incentive compensation an employee shall have worked no less than one (1) year for the City. As a further condition to such qualification, all sworn personnel shall be required to undertake and maintain all educational programs set forth by law under the Peace Officers Standards and Training Program. Section 10. Sick Leave. Upon termination of employment, by resignation, retirement or death, a miscellaneous employee who leaves the municipal service in good standing shall receive compensation for all accumulated unused sick leave based upon the rate of two percent (2%) for each year of service, to a maximum of fifty percent (50%). Section 11. Automobile Allowance. Any employee or City official shall be reimbursed at the rate of seventeen cents (17(�) per mile for use of his private car when traveling on authorized City business. Section 12. Uniform Allowance. Uniformed members of the Police Depart- ment shall receive a uniform allowance in the amount of $125.00 at the completion of each six months of service ending June 30 and December 31; a proration at the rate of $20.83 may be given for a portion of the first and last six months of service upon recommendation of the Department Head and approval of the City Manager. Administrative and Investigative personnel who occasionally wear a uniform shall receive $200.00 annually as a uniform allowance. 3. 3-, Section 13. Insurance Program. Effective July 1, 1977, a maximum of $80.00 per month will be contributed by City toward the cost of each eligible employee's Health, Accident, Life, and Disability Insurance Package. Selection of coverage must include the employee's basic health plan and the $5,000.00 life insurance policy offered by the City. Section 14. Dental Insurance. Effective July 1, 1976, the City will provide and pay the premiums to have a dental insurance program carried by the California Dental Service, Program III A, as shown in CDS proposal dated May 7, 1976, at the premium rate quoted therein under the heading "Super -Composite." In the event that the rate is increased at any time after July 1, 1978 but before June 30, 1979, the City shall continue the Program and shall pay the increased rate from the date of the increase for the term of this resolution, to the extent that said increase does not exceed ten percent (10%); any increase exceeding that percentage shall be repaid to City by a reduction in monthly salaries across the board in an amount equal to the monthly increase in the premium rate, to the extent that it exceeds ten percent (10%). Section 15. Retirement Program. Effective July 1, 1977, the City will join the "present" system of the Employees' Retirement Association of the County of Marin as described in the actuarial studies performed by Coates, Herfurth & England, dated April 29, 1976 and July 1, 1975, on behalf of all employees covered by this resolution, including both general and safety personnel, and including active and inactive retired members, as set forth in said actuarial studies; provided, however, that if City fails to join as of July 1, 1977, the above-mentioned "present" system of the Marin County Employees' Retirement Association, on behalf of all the above- mentioned employees, for whatever reason, including but not limited to the failure to fulfill any condition precedent to the City's entry into such system, the parties to this resolution shall reopen the process of meeting and conferring in good faith with respect both to all matters covered by this resolution and all matters within the scope of meeting and conferring, and all provisions of this resolution and all matters within the scope of meeting and conferring shall be renegotiated retroactive to July 1, 1976. Section 17. Management Personnel. The positions of Chief of Police, Police Captains, Police Lieutenants, and Secretary to the Chief of Police are deemed to be management positions and shall be excluded from the bargaining unit represented by the Association. 4. Section 18. Effective Date. This resolution shall take effect forthwith upon its adoption and the several compensations and allowances herein provided shall be in full force and effect as of and from July 1, 1976 through June 30, 1979 I, MARION A.
