HomeMy WebLinkAboutResolution No. 5075RESOLUTION NO. 5075 RESOLUTION OF THE COUNCIL OF THE CITY OF SAN RAFAEL CONFIRMING CANVASS BY BOARD OF SUPERVISORS OF MARIN COUNTY OF SPECIAL MUNICIPAL ELECTION CONSOLIDATED WITH THE GENERAL DISTRICT ELECTION NOVEMBER 4, 1975 WHEREAS, the Board of Supervisors of Marin County has duly canvassed or caused to be canvassed the votes cast in that certain territory known and designated as "San Rafael Meadows Annexation"; and WHEREAS, the "San Rafael Meadows Annexation" is more parti- cularly described in Exhibit "A" attached hereto; and _WHEREAS the Special Municipal Election was consolidated with the General District Election held on November 4, 1975, in the area known as the "San Rafael Meadows Annexation" and by the electors of that territory upon the measure; and WHEREAS, the results of the Special Municipal Election have been certified to the San Rafael City Council and said certification is now on file in the Office of the City Clerk of the City and attached hereto as Exhibit "B"; NOW THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael as follows: 1. The canvass of the Special Municipal Election by the Marin County Board of Supervisors as shown by the certification of Exhibit "B" and the election results are hereby ratified, confirmed, and approved; 2. At the Special Municipal Election a measure (attached hereto as Exhibit "C") was submitted to the electors of that certain territory, known and designated as "San Rafael Meadows Annexation" for the purpose of submitting to the electors residing in San Rafael Meadows territory the question of whether such district shall be annexed to, incorporated in, and made a part of the City of San Rafael and subject to taxation equally with the property within the City of San Rafael to pay the entire bonded indebtedness of the City of San Rafael outstanding or authorized excepting therefrom the City of San Rafael General Obligation Sewer Bonds, April 21, 1971 Issue; .URIGI s� 3. The number of votes cast in the territory for and against said measure was as follows: Total Total Vote Vote "YES" "NO" 193 129 4. The total number of votes cast in the "San Rafael Meadows Annexation" territory at the Special Municipal Election and the total number of votes given in each precinct and by absentee voters of the territory for and against said measure was and is set forth in the canvass by the Marin County Board of Supervisors and attached as Exhibit "B". I, MARION A. GRADY, Clerk of the City of San Rafael hereby certify that the foregoing Resolution was duly and regularly intro- duced and adopted at a regular meeting of the Council of said City held on Monday , the 1st day of December , 1975, by the following vote, to -wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None Approved as to Form and Content MARION A. GRADY, City Cclerk - 2 - June 123, 1975 DESCRIP'T'ION OF SAN RAFAEL MaADOWS /���E\ATION TO THE CITY OF SAN RAFAEL Beginning at a point on the existing San Rafael City limit line, said point being the intersection of the courses S 56° 34' 30" IV and N 7° 57' 00" IV, 287.39 feet; said intersection being the most southerly corner of the parcel described in Book 1758 of Deeds, at page 429, Turin County Records; thence leaving said existing San Rafael City Limit line, and proceeding N S6° 34' 30" E, 330.45 feet to the westerly line of Ranchitos Road, said point being the most northerly coiner of Lot 21 as'shown on Record of Survey, Book 2, page 116, Amended Record of Survey of Los Ranchitos, Turin County Records; thence along the westerly line of Ranchitos Road, along a curve to the right with a radius of 970 feet for a distance of 51.767 feet, as said line is described in Book 192 of Deeds, at page 20, Turin County Records; thence S 89° 55' E, 60.feet t more or less to a point on the easterly line of Ranchitos Road, said point being 30 feet easterly of the intersection of the centerline courses R=1000 feet, L=250.75 feet, and S 0° 05' IV, 269.79 feet, as said centerline is de- scribed in Book 192 of Deeds, at paje 20; thence along said easterly right of way line as described by the roadway centerline, S 0° 05' IV, 269.79 feet; thence along a curve to the left, tangent to said last named course, with a radius of 1040 feet for a distance of 1482.06 feet; thence S 83° 46' E, 722.69 feet; as said course is described in Book 192 of Deeds, at page 20; thence.. along said right of way, curving southeasterly to the right along a curve with a radius of 1660 feet for- a distance of 1126.SS feet more or less; thence con- tinuing along the northerly line of Ranchitos Road, 60 feet northerly of the centerline, as said northerly line is described by the centerline description commencing at a point on the centerline Imo -%.n as Sta "LI" 877+04.87 P.T.; thence (Cont irnaed) S 390 42' E, 359.10 feet; thence curving to the left tangent to said last named course with a radius of 300 feet for a distance of 421.06_feet; thence N 590 S3' E, SO feet more or less to a point of intersection of the following two courses: S 61° O1' 06" IV, 65.00 feet and S 28° 58' 54" E, 119.99' as said courses are shown on the State of California, Highway 101, Right of Way Record Map, R.87.7, said point of intersection being on said State of California Right of Way; thence leaving the northerly line of Ranchitos Road and crossing to the southerly line thereof, along said State of California Right of Way, S 28° 58' 54" E, 119.99 feet; thence S 61' O1' 06" W, 49.35 feet; thence leaving said right of way, S 40° 53' 54" E, 70 feet more or less to intersect the course, N 660 30' E, 198.0 feet, said course being on the existing San Rafael City Limit line; thence proceeding northeasterly, northwesterly and southeasterly along the existing San Rafael City Limit line to the point of beginning.
