RESOLUTION AUTHORIZING THE SIGNING OF A GRANT
OF EASEMENT TO PACIFIC GAS AND ELECTRIC COMPANY
FOR INSTALLATION AND MAINTENANCE OF UNDERGROUND
AND OVERHEAD ELECTRICAL LINES THROUGH THE
MONT MARIN OPEN SPACE AREA
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a Grant of Easement to Pacific Gas and
Electric Company for installation and maintenance of overhead and
underground electrical lines adjacent to Old Lucas Valley Road and
underground electrical lines only through the Mont Marin Open Space
Area. A copy of said Grant of Easement is hereby attached and by this
reference made a part hereof.
I, MARION A. GRADY, City Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a REGULAR meeting of the City Council of said
City held on TUESDAY, the 7TH day of SEPTEMBER, 1976, by the following
vote, to wit:

EASEMENT
CITY OF SAN RAFAEL, a public body of the State of California
first party, hereby grants to PACIFIC GAS AND ELECTRIC COMPANY, a California
corporation,
second party, the right from time to time to construct, install, inspect, maintain, replace,
remove, and use facilities of the type hereinafter specified, together with a right of way
therefor, within a strip or parcel of land or along a route as hereinafter set forth, and also
ingress thereto and egress therefrom, over and across the lands situate in the City of
San Rafael County of Marin , State of Callforma, described
as follows:
1.) The strip of land 10 feet in width and 215 feet in length, the
center line of which is delineated by the heavy dashed 'ine shown
upon the print of second party's Drawing No. BN 1345 at -ached
hereto and made a part hereof; being a portion of t, -ie pa° --el of
land described and designated PARCEL TWO in the deed `--om Rubin
Glickman and others to the City of San Rafael dated March 7, 1973
and recorded in Book 2667 of Official Records at nage 511, !Marin
County Records.
2.) The strip of land 10 feet in width and 1195 feet in length, outlined
by a heavy dashed line on second party's Drawing No. Bpi '346
attached hereto and made a part hereof; being a portion of the
parcel of land described and designated PARCEL ONE in the deed from
Rubin GLickm,an and others to the City of San Rafael Mateo ^"arch 7,
1973 and recorded in Book 2667 of Official Records at p -;e 511,
Marin County Records.
Said facilities shall consist of:

Such overhanging wires, cables, crossarms, fixtures, and appurtenances,
as second party deems necessary located within the strip of land herein-
before described and designated 1.).
Such underground conduits, pipes, manholes, service boxes, wires, cables, and
electrical conductors; aboveground marker posts, risers, and service
pedestals; underground and aboveground switches, fuses, terminals, and
transformers with associated concrete pads; and fixtures and appurtenances
necessary to any and all thereof, as second party deems necessary located
within the strip of land hereinbefore described and designated 2.).
First party shall not erect or construct any building or other structure or
drill or operate any well within the strip of land outlined by the heavy
dashed line.
First party also grants to second party the right of ingress to and egress
from said strips over and across the lands of first party lying adjacent to
said strips by means of roads and lanes thereon, if such there be, otherwise
by such route or routes as shall occasion the least practicable damage and
inconvenience to first party.

Second party shall also have the right to trim
and clear away or otherwise control any trees or brush along said
facilities whenever considered necessary for the complete enjoyment of the rights hereby granted.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the
respective parties hereto.
