A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
CONSENTING TO THE COMMENCEMENT OF PROCEEDINGS FOR THE
ANNEXATION OF CERTAIN INHABITED TERRITORY DESIGNATED AS THE
"SAN RAFAEL MEADOWS ANNEXATION"
WHEREAS, on the 9th day of April, 1975, an application was filed with
the Local Agency Formation Commission applying for annexation of certain in-
habited territory therein referred to and generally described, which is conti-
guous to the City of San Rafael; and
WHEREAS, the Local Agency Formation Commission by Resolution No.
75-16, approved on May 21, 1975, the annexation of that certain inhabited
territory subject to the following conditions:
(a) The City of San Rafael prezone the area of the proposed annexa-
tion, such prezoning to be completed prior to the date of any
election.
(b) Flood Control Zone #6, of the Marin County Flood Control Dis-
trict, be continued.
(c) The area within the annexation and within County Service Area
#18 shall remain within the County Service Area #18.
(d) The entirety of the area annexed shall be detached from County
Service Area #19.
WHEREAS, said application for annexation was referred to the Planning
Commission of the City of San Rafael for investigation, report and recommendation;
and
WHEREAS, the Planning Commission rendered its report and recommendation
to the Council on the 11th day of March , 1975, favoring the com-
mencement of annexation proceedings; and
WHEREAS, it is the desire of the City Council to give its consent to the
commencement of such annexation proceedings upon condition that the electors
within said territory be informed at the time the petition for annexation is circulated
that the question to be submitted to said electors shall be whether the territory shall
be annexed, and the property in the territory subjected to taxation after annexation
equally with property within the City of San Rafael to pay the entire bonded indebted-
ness of the City of San Rafael outstanding or authorized at the date of the first publi-
cation of the notice of election, for the acquisition, construction or completion of
municipal improvements, excepting therefrom the City of San Rafael General Obligation
Sewer Bonds, April 21, 1971 Issue.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
San Rafael:
1 . That consent be and hereby is granted for the commencement of
annexation proceedings in connection with said inhabited territory
in accordance with the Annexation Act of 1913, provided the
petition for annexation contains a request that the question to
be submitted to the electors residing in the territory proposed to
be annexed shall be whether the territory shall be annexed, and
the property in the territory subject to taxation after annexation
equally with property within the City of San Rafael to pay the
bonded indebtedness of the City of San Rafael outstanding or
authorized at the date of the first publication of the notice of
election for the acquisition, construction or completion of muni-
cipal improvements, excepting therefrom the City of San Rafael
General Obligation Sewer Bonds, April 21, 1971 Issue.
2. That said unincorporated territory be and hereby is designated as
the "San Rafael Meadows Annexation" and is described in Exhibit
"A" attached hereto.
3. The City Clerk shall certify to the adoption of this resolution.
