A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL
AMENDING RESOLUTION NO. 4501 PERTAINING TO
THE COMPENSATION AND WORKING CONDITIONS FOR
FIRE DEPARTMENT PERSONNEL
WHEREAS, the State of California has established under the Meyers-Milias-
Brown Act general rules and criteria by which municipalities meet and confer with
representatives of the respective employee groups; and
WHEREAS, the City of San Rafael, in compliance with the statutory require-
ments of this Act, adopted Resolution No. 4027 defining rules and procedures for
meeting and conferring with the employee groups concerning matters of wages, fringe
benefits and working conditions; and
WHEREAS, Local 2208 of the International Association of Firefighters stands
as the recognized unit for the positions of Fireman, Fire Engineer, Fire Captain,
Fire Training Officer, Battalion Chief and Fire Marshall; and
WHEREAS, the City received from the negotiating team of Local 2208 of the
International Association of Firefighters nineteen (19) items of discussion to be dealt
with in negotiations relative to the 1975/1976 fiscal year; and
and
and
WHEREAS, the City met and conferred in good faith with the negotiation team;
WHEREAS, no resolution was reached during the meeting and conferring sessions;
WHEREAS, the negotiation team of Local 2208 of the International Association
of Firefighters declared an impasse under the procedure detailed in Resolution No.
4027 of the City of San Rafael; and
WHEREAS, the City negotiation team and the negotiation team of Local 2208
of the International Association of Firefighters had a final impasse meeting; and
WHEREAS, representatives of Local 2208 of the International Association of
Firefighters addressed the San Rafael City Council at its meeting of May 19, 1975;
and
WHEREAS, the City requested that mediation be initiated as defined by
Resolution No. 4027; and
WHEREAS, pursuant to the provisions of Resolution No. 4027, both the City
and Local 2208 of the International Association of Firefighters have appointed re-
presentatives, and these representatives have chosen a third individual to participate
in the process of mediation and fact-finding; and

WHEREAS, the mediation was attempted on two different days in sessions
involving the City, the negotiation team of Local 2208 of the International Association
of Firefighters and the mediation and fact-finding board; and
WHEREAS, no resolution came forth from the mediation proceedings; and
WHEREAS, fact-finding was requested by the City of San Rafael, but rejected
by the negotiation team representing Local 2208 of the International Association of
Firefighters; and
WHEREAS, it is now appropriate for the San Rafael City Council to act on
salaries, fringe benefits and working conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San
Rafael as follows:
Section 1. Salaries. The salary ranges for the 1975/1976 fsical year for
those positions represented by Local 2208 of the International Association of
Firefighters is included as Exhibit "A". Said salaries are to become effective
July 1, 1975.
Section 2. Section 10 of Resolution No. 4501 shall be amended to read as
f ollows :
Insurance Program. As an added fringe benefit, a maximum amount
of Sixty Dollars ($60.00) per month will be contributed towards the
cost of each eligible employee's Health, Accident, Life and Disa-
bility insurance package. Selection of coverage must include the
employee's basic health plan and $5,000 life insurance policy
offered by the City.
Section 3. Safety Committee. The City agrees to appoint a City-wide Safety
Committee, one member of which shall be from the Fireman or Fire Engineer classi-
fication.
Section 4. Residency. Within one year of employment, all new employees in
those classifications represented by Local 2208 of the International Association of
Firefighters shall have their principal place of residence within a twenty-five (25)
mile radius of Fire Station #1 of the City of San Rafael.
Section 5. Educational Incentive. All individuals receiving educational in-
centive pay must recertify their educational achievement by June 30, 1976 in order
to continue receipt of this benefit. Recertification shall consist of 60 hours of
instruction approved by the Fire Chief. Normal departmental instruction shall not
be considered within the context of this recertification. This requirement shall be
deemed complete upon passing the improved course of instruction and having the
school, college or institution acknowledge this completion in writing to the Fire
Chief .
Those failing to be recertified by June 30, 1976 shall not receive the educational

benefit for which tye now qualify until the recertification is achieved.
Upon achieving recertification, the receipient of the educational benefit
shall continue to be recertified in respect to the above requirements every two
years.
Section 6. Management Personnel. In addition to the position of Fire
Chief, the positions of Battalion Chief and Fire Marshall are deemed to be manage-
ment positions and are to be included within the Unclassified Salary Schedule for
salaries and fringe benefit information.
Section 7. Call -Back. The City agrees to a minimum of two hours call-
back pay at time -and -one-half whenever an employee in the classifications of
Fire Captain, Fire Engineer, Fireman, Fire Prevention Inspector and Fire Engineer
Mechanic are asked to continue their work schedule past the duty day or are called
back by the Department.
Section 8. Retirement. The City Council states its willingness to order
an actuarial survey concerning the transfer from the Public Employment Retirement
System. This survey will be initiated upon a pledge by the recognized employee
organizations to pay one-half of the cost of the survey, with their cost not to
exceed $1,500. The City agrees to release the actuarial survey to the employee
groups upon receipt. This action will in no way commit the City to termination
of its present retirement system and does not commit the City to transfer to the
Marin County Retirement System.
Section 9. Health Standards. The City Council states its intent to adopt
by ordinance health standards for Fire Department personnel as detailed in the
draft ordinance previously discussed with the representatives of Local 2208 of
the International Association of Firefighters.
Section 10. This resolution shall take effect forthwith upon its adoption
and the several compensations and allowances herein provided shall be in full
force and effect as of and from July 1, 1975.

the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City on Monday , the
