HomeMy WebLinkAboutResolution No. 4994RESOLUTION NO. 4994 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL FIXING THE COMPENSATION AND WORKING CONDITIONS FOR POLICE DEPARTMENT PERSONNEL WHEREAS, the State of California has established under the Meyers- Milias-Brown Act general rules and criteria by which municipalities meet and confer with representatives of the recognized employee organizations; and WHEREAS, the City of San Rafael, in compliance with the statutory re- quirements of this Act, adopted Resolution No. 4027 defining rules and procedures for meeting and conferring with the recognized employee organizations concerning matters of wages, fringe benefits and working conditions; and WHEREAS, the San Rafael Police Association stands as the recognized unit for all employees of the Police Department, except the Police Chief, Police Captains and Secretary to the Police Chief; and WHEREAS, the City met and conferred in good faith with the representa- tives of the Association; and WHEREAS, no resolution was reached during the meeting and conferring sessions; and WHEREAS, the representatives of the Association declared an impasse under the procedure detailed in Resolution No. 4027 of the City of San Rafael and requested mediation; and WHEREAS, pursuant to the provisions of Resolution No. 4027, both the City and the Association appointed representatives, who in turn chose a third individual to participate in the process of mediation; and WHEREAS, following the commencement of mediation the representatives of the City and of the Association reached agreement and entered into a Memorandum of Understanding; and WHEREAS, the City Council has considered and approved the said Memo- randum of Understanding; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael as follows: Section 1. Salaries. The salary ranges for the 1975/1976 fixcal year for those positions represented by the San Rafael Police Association is included as Exhibit "A", with salaries to become effective July 15, 1975. Section 2. Salary Designations. The salaries herein established are monthly compensation unless otherwise specified. =W Section 3. The Administration of the Pay Plan. Salary advancements shall be made on the basis of the salary rates, salary ranges and salary steps set forth opposite each classification in this resolution. Before any person is advanced to the next step, a written statement must be filed by the department head with the City Manager recommending such increase. The steps of each salary range shall be applied as follows: The first step is the minimum rate and shall normally be the hiring rate for the class. In cases where it is difficult to secure qualified personnel, or if a person of unusual qualifications is engaged, the City Manager may hire at a higher step. The re- maining steps represent the ordinary next salary steps for each year of service, providing the employee is qualified in his work to receive the next step. Anniversary date shall be interpreted as the 1st day of the month for those employees entering the ser- vice between the 1st and the 15th of the month and on the 1st day of the next month for those entering the service after the 15th of a month. The semi-monthly pay periods shall be adjusted to the 1st and 15th day of each month. Section 4. Appointments and Salaries. The City Manager, in accordance with the Personnel Rules and Regulations, may make appointments of prospective employees to a position in a class for which the salary is here- in provided and designate the definite salary rate or salary step at which such person is appointed. The salary so designated is thereby fixed as the salary of such employee for such position; provided, further, that the City Manager may from time to time increase or decrease the salaries of persons so appointed in accordance with provisions of Section 1, provided that the salary so fixed is within the ranges established for that classification Section 5. Part -Time and Temporary Employment. Employees appointed to any of the positions referred to herein and employed or working on a part- time basis shall be paid in proportion to the time worked and described in their appointment. Temporary employees may be appointed by the City Manager when authorized budget funds are available. Section 6. Additional Pay for Police Department. Police Department personnel assigned to the following duties shall receive additional compensa- tion amounting to five percent (5%) of their basic monthly salary: (a) Police Sergeant serving as Investigative Supervisor. (b) Police Sergeant serving as Juvenile Officer. (c) Patrolman serving in Investigative Division (d) Patrolman serving in Juvenile Division. (e) Operation of a solo -motorcycle for more than 50% of his work month. Female employees who are requested to perform the duties of Police Matron shall receive $2.50 per hour in addition to their regular hourly rate of pay for only actual time served in this capacity. - 2 - Section 7 . Holidays. The shift personnel in the Police Department, namely the Police Lieutenant, Police Sergeant, Police Inspector, Patrolman, Radio Telephone Operator and Police Cadet, are entitled to straight time compensation for every holiday in each given year which all other City employees received as time off. Said compensation shall be paid twice each year on the first pay period of December and the first pay period of June. Section 8. Overtime. All miscellaneous employees with the exception of Department Heads and supervisory personnel, who are required to work in excess of their basic work week during any one week shall be given compensa- tory time off at the rate of time and one-half, or, upon the recommendation of the Department Head and subject to approval of the City Manager, shall be paid at the rate of time and one-half of their established hourly rate, based on their regular monthly salary. Upon accrual of five (5) days of forty (40) hours of overtime, members of the Police Department shall be paid at the rate of time and one-half of their estab- lished hourly rate. Notification by the Officer in Charge directing that compensatory time be taken, or by the employee's requesting compensatory time off, on any specific date must be submitted not less than five (5) days in advance for the mutual agree- ment of both parties. In addition, those members who are required in the course and scope of their official employment to appear in Court other than during their regular tour of duty or shift of hours, shall receive a minimum of two (2) hours pay at the rate of time and one-half of their established hourly rate. In the event that an em- ployee resigns or is terminated, he shall be entitled to compensation for his accumulated overtime. For the purpose of computing overtime, the work shall be defined as beginning at 12:01 A.M. Sunday morning and ending at 12:00 midnight Saturday. Section 9. Educational Incentive Program for Safety Personnel. To increase the educational level of the employees in the Police Department and to assist in the recruitment of public safety members into the field of law enforcement, the City shall pay an educational incentive in accordance with the following: (a) Those employees possessing a Peace Officers Standards of Training Intermediate Certificate shall receive additional compensation, amounting to 5% of their basic monthly salary. (b) Those employees possessing a Peace Officers Standards of Training Advanced Certificate shall receive additional compensation, amounting to 71% of their basic salary. - 3 - To qualify for educational incentive compensation an employee shall have worked no less than one (1) year for the City. As a further condition to such qualification, all sworn personnel shall be required to undertake and maintain all educational programs set forth by law under the Peace Officers Standards and Training Program. Section 10. Sick Leave. Upon termination of employment, by re- signation, retirement or death, a miscellaneous employee who leaves the muni- cipal service in good standing shall receive compensation for all accumulated unused sick leave based upon the rate of two (27.) percent for each year of service, to a maximum of fifty (50%) percent. Section 11. Automobile Allowance. Any employee or City official shall be reimbursed at the rate of seventeen (170 cents per mile for use of his private car when traveling on authorized City business. Section 12. Uniform Allowance. Uniformed members of the Police Department shall receive a uniform allowance in the amount of $125.00 at the completion of each six months of service ending June 30 and December 31; a proration at the rate of $20.83 may be given for a portion of the first and last six months of service upon recommendation of the Department Head and approval of the City Manager. Administrative and Investigative personnel who occasionally wear a uniform shall receive $200.00 annually as a uniform allowance. Section 13. Insurance Program. As an added fringe benefit, a maxi- mum amount of $75. 00 per month will be contributed towards the cost of each eligible employee's Health, Accident, Life and Disability Insurance Package. Selection of coverage must include the employee's basic health plan and $5,000.00 life insurance policy offered by the City. Section 14. Residency Requirement. Within one year of employment, all new employees in those classifications represented by the Association shall have their principal place of residence within a twenty-five (25) mile radius of the San Rafael City Hall, said radius extending to, and including the corporate limits of the cities of Rohnert Park, Cotati, and Glen Ellen. Section 15. Management Personnel. The positions of Chief of Police, Police Captains, Police Lieutenants, and Secretary to the Chief of Police are deemed to be management positions and shall be excluded from the bargaining unit repre- sented by the Association. Section 16. Retirement. The City Council states it willingness to order an actuarial survey concerning the transfer from the Public Employment Retirement System. This survey will be initiated upon payment by the Association and by the Firemen's Union of $500 each toward the cost of the survey. The City - 4 - agrees to release the actuarial survey to the Association upon receipt. This action will in no way commit the City to termination of its present retirement system and does not commit the City to transfer to the Marin County Retire- ment System. Section 17. Effective Date. This resolution shall take effect forthwith upon its adoption and the several compensations and allowances herein provided shall be in full force and effect as of and from July 15, 1975. I, MARION A.
