A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL
AMENDING RESOLUTION NO. 4501 PERTAINING TO
THE COMPENSATION AND WORKING CONDITIONS FOR
FIRE DEPARTMENT PERSONNEL
AND REPEALING RESOLUTIONS NO. 4980 AND NO. 4986
WHEREAS, the State of California has established under the Meyers-Millias-
Brown Act general rules and criteria by which municipalities meet and confer with
representatives of the respective employee groups; and
WHEREAS, the City of San Rafael, in compliance with the statutory require-
ments of this Act, adopted Resolution No. 4027 defining rules and procedures for
meeting and conferring with the employee groups concerning matters of wages, fringe
benefits and working conditions; and
WHEREAS, Local 2208 of the International Association of Firefighters, here-
inafter referred to as the Union, stands as the recognized unit for the positions of
Fireman, Fire Engineer, Fire Captain, and Fire Training Officer; and
WHEREAS, the City received from the negotiating team of the Union nine-
teen (19) items of discussion to be dealt with in negotiations relative to the 1975/
1976 fiscal year, and
and
WHEREAS, the City met and conferred in good faith with the negotiation team;
WHEREAS, no resolution was reached during the meeting and conferring
sessions; and
WHEREAS, the negotiation team of the Union declared an impasse under the
procedure detailed in Resolution No. 4027 of the City of San Rafael; and
WHEREAS, the City negotiation team and the negotiation team of the Union
had a final impasse meeting; and
WHEREAS, the City requested that mediation be initiated as defined by
Resolution No. 4027; and
WHEREAS, pursuant to the provisions of Resolution No. 4027, both the City
and the Union have appointed representatives, and these representatives have chosen
a third individual to participate in the process of mediation and fact-finding; and
WHEREAS, the mediation was attempted on two different days in sessions
involving the City, the negotiation team of the Union, and the mediation and fact-
finding board; and
WHEREAS, no resolution came forth from the mediation proceedings; and
,
WHEREAS, fact-finding was requested by the City of San Rafael, but rejected
by the negotiation team representing the Union; and
WHEREAS, representatives of the City and the Union have subsequently met
and have entered into a Memorandum of Understanding for the fiscal year 1975/1976;
and
WHEREAS, it is now appropriate for the San Rafael City Council to act on
salaries, fringe benefits and working conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San
Rafael as follows:
Section 1. Salaries. The salary ranges for the 1975/1976 fiscal year for
those positions represented by the Union are included as Exhibit "A". Said salaries
are to become effective July 1, 1975.

Section 2. Section 10 of Resolution No. 4501 shall be amended to read as
Insurance Program. As an added fringe benefit, a maximum amount
of Seventy Dollars ($70.00) per month will be contributed towards the
cost of each eligible employee's Health, Accident, Life and Disa-
bility insurance package. Selection of coverage must include the
employee's basic health plan and $5,000 life insurance policy
offered by the City.
Section 3. Safety Committee. The City agrees to appoint a City-wide Safety
Committee, one member of which shall be from the Fireman or Fire Engineer classi-
f ication .
Section 4. Residency. Within one year of employment, all new employees
in those classifications represented by the Union shall have their principal place of
residence within a twenty-five (25) mile radius of Fire Station #1 of the City of San
Rafael.
Section 5. Educational Incentive. The educational incentive program now
in existence for employees of the Fire Department shall continue; provided, however,
that in the event that the Union prepares and submits to the City an educational
recertification program, and such program is adopted by the City Council, an addi-
tional 2z% compensation shall be granted in the two categories now provided for in
the existing educational incentive program, upon fulfilling the requirements of the
recertification program.
Section 6. Management Personnel. In addition to the positions of Fire
Chief and his secretary, the positions of Battalion Chief and Fire Marshall are
deemed to be management positions and are to be included within the Unclassified
Salary Schedule for salaries and fringe benefits.
Section 7. Call -Back. There shall be a minimum of two hours call-back
pay at time -and -one-half whenever an employee in the classifications of Fire

Captain, .Fire Engineer, Fireman, Fire Prevention Inspector and Fire Engineer
Mechanic are asked to continue their work schedule past the duty day or are called
back by the Department.
Section 8. Retirement. The City will pay $1,500 toward the cost of an
actuarial study to be conducted by the Marin County Retirement System; and if
the miscellaneous employees' union desires not to participate, the City will pay
an additional $500; upon receipt of the sum of $500 from the Union and from the
Police Association, the City will immediately order the study and will deliver the
completed study to the Union upon receipt by the City. The City does not commit
itself to join the Marin County Retirement System but will meet and confer with
the Union on that issue after the actuarial study is completed.
Section 9. Medical Standards Ordinance. A medical standards ordinance
to be applicable to Fire Department personnel in the classifications of Fireman,
Engineer, and Captain will be discussed by the City and the Union and will be
adopted only after mutual agreement by both parties.
Section 10. Personnel Rules and Regulations. The personnel rules and
regulations, to be revised after meeting and conferring with the Union, shall con-
tain a provision requiring the filling of vacancies from within the top three names
on a certified list, for all personnel appointments and promotions within the
classified service.
Section 11. Repeal. Resolutions No. 4980 and No. 4986 are hereby repealed.
Section 12. This resolution shall take effect forthwith upon its adoption
and the several compensations and allowances herein provided shall be in full
force and effect as of and from July 1, 1975.
