A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
RESCINDING RESOLUTION NO. 4988 AND AUTHORIZING THE SIGNING
OF PROGRAM SUPPLEMENT NO. 1 (REVISED) TO THE CITY-STATE
AGREEMENT NO. 3 FOR CITY'S FEDERAL -AID URBAN SYSTEM PROJECT
WHEREAS, the City Council did, on July 7, 1975, adopt
Resolution No. 4988 authorizing execution of Federal -Aid Urban System
Project Supplement No. 1 with the State of California; and
WHEREAS, the City Council, subsequent to adoption of said
Resolution No. 4988, required certain changes to Exhibit B of said
Supplement No. 1 relative to the utilization of a local engineer or
surveyor in lieu of State forces on City's current Federal -Aid Urban
Roadway Improvement Project; and
WHEREAS, the State of California has submitted to City a
- Revised Program Supplement No. 1 for execution by City; and
WHEREAS, City is desirous to rescind previously adopted
Resolution No. 4988.
NOW, THEREFORE, BE IT RESOLVED that said Resolution No. 4988
is hereby rescinded and that the Mayor and City Clerk are authorized to
execute, on behalf of the City of San Rafael, Program Supplement No. 1
(Revised) to the City -State Agreement No. 3 for City's Federal -Aid Urban
System Project, subject to the State of.California modifying Exhibit B
of said Revised Program Supplement No. 1 so as to reflect construction
engineering and actual project bid prices plus contingencies, a copy of
which Supplement is attached hereto and by this reference made a part hereof.

certify that the foregoing resolution was duly and regularly introduced
and adopted at a REGULAR meeting of the City Council of said City held on
MONDAY, the 20TH day of OCTOBER, 1975, by the following vote, to wit:

opeclal Covenants or Kemarks: 1. All maintenance, involving the physical condition and the operation of the improvements, referred to
in Article VI MAINTTENANCE of the aforementioned blaster Agreement will be performed by
CITY OF SAN RAFAEL at regular intervals or as required For efficient
operation of the completed improvements.
2. This project is No. 3 on the County priority list for 1971-72 and 1972-73 FAU Funds.
Should higher priority projects cause increase or decrease to the Federal funds
available, this project will be financed with the remaining 71-72, 72-73 Federal funds.
The present available FAU funds are approximately $190,000.

3. The remaining FAU funds for this project are from the 3 -year FAU Program of the 1973 Highway Act. The
use of these funds is based on the project being part of the three (3) year FAU Program for Marin County's
portion of the San Francisco -Oakland Urbanized Area.
4. Unless determined otherwise by Marin County's Cooperative Process Committee, the actual funds for the
project will be set up on the basis of contract prices after the bids for the work have been opened. In
awarding, or agreeing to award the contract, the City agrees to use maximum Federal Funds based on bid
prices as established in the Detail Estimate and accepts any increase in Local Agency Funds.
5. Should higher priority projects cause increase or decrease to the Federal funds available, this project
will be financed with the maximum Federal funds available to the County.
6. Should additional Federal Funds become available to the City, this amount will, at the City's request, be
increased to the amount available but not to exceed the maximum legal Federal prorata share with a
corresponding decrease in the matching funds.
7. The City share of matching funds for Construction Engineering will be 100% of the amount remaining after
Federal participation for the 71-72, 72-73 portion of the project and 100% City funds for the remainder
of the project.
8. The City share of matching funds for Construction will be 100% of the amount remaining after Federal
participation.
9. The City will advertise, award and administer the project and bear the entire cost thereof.
10. In accordance with Section 86-2.14A of State Standard Specification for testing controllers, the City
agrees to pay their share of the cost of testing if performed by the State.
11. The availability of Federal Funds will be subject to meeting deadlines and/or other conditions as may
be imposed by the Director upon the recommendation of the TOPICS Advisory Committee (Urban System).
12. Exhibit "C", attached hereto, supplements the aforementioned Master Agreement in regard to the 1973
Federal -Aid Highway Act.
13. "The last sentence of Part 4, Article V, of the Master Agreement for the Federal -Aid Urban System Program
between the CITY OF SAN RAFAEL and the STATE regarding the time which project documents must be retained is
superseded. Following final settlement of the project accounts with the Federal Highway Administration,
such records and documents may be microfilmed at the option of LOCAL AGENCY but in any event shall be retained
for a 3 -year period after submission of the final voucher or a 4 -year period from the date of final payment
under the contract, whichever is longer."

FAU AGREEMENT
EXHIBIT "C"
1973 FEDERAL -AID HIGHWAY ACT SUPPLEMENT:
All references to the Federal -aid Highway Act of 1970 in this
agreement shall include the Federal-aid�Highway Acts of 1970
and 19 73 .
The Federal -aid Highway Act of 1973 expanded the Federal -aid
Urban System program to:
Include urban areas with populations between 5,000 and
50,000. The use of the term urbanized in this agreement
shall mean urban when this agreement covers projects in
areas having between 5,000 and 50,000 population.
Provides for the expenditure of Urban System funds on
mass transit projects. This agreement shall be deemed
to cover projects of this nature.
This exhibit deletes or revises specific paragraphs of the
agreement as follows:
. Article I, paragraph I - revise to read:
"All projects, excepting mass transit projects, must
be on an approved Federal -aid Urban System route."
. Article II, paragraph 2b - delete.
. Article II, paragraph 2c - revise to read:
"The project selected by a cooperative process and
included in the area's approved 3 -year program."
. Article II, paragraph 3 - delete.
