Home My WebLink AboutResolution No. 5060RESOLUTION NO. 5060 RESOLUTION CONSENTING TO THE TRANSFER OF TERRITORY DESIGNATED AS THE FREITAS TRANSFER FROM THE CITY OF SAN RAFAEL TO THE CITY OF SAN ANSELMO WHEREAS, Mr. Edward Freitas, the owner of record of Assessor's Parcel No. 10-272-01, is requesting the transfer of said parcel from the City of San Rafael to the City of San Anselmo; and WHEREAS, on August 20, 1975, the Marin Local Agency Formation Commission considered said transfer proposal and adopted Resolution No. 75-24 making deter- minations and approving said transfer; and WHEREAS, Resolution No. 75-24 adopted by the Marin Local Agency Formation Commission designated the transfer proposal as the "Freitas Transfer," and found that the territory of the transfer was uninhabited; and WHEREAS, following approval of the Local Agency Formation Commission further proceedings on the transfer may be taken pursuant to Article 4.5 (commencing with Section 35270) of Chapter 1, Part 2, Division 2, Title 4 of the Government Code; and WHEREAS, pursuant to Section 35271 of said Article 4.5, the City from which territory is proposed to be transferred, must consent to said transfer by resolu- tion adopted by its City Council, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: 1. The Council hereby does consent to the Transfer of Territory designated as "Freitas Transfer" from the City of San Rafael to the City of San Anselmo. 2. The Clerk of this Council is hereby directed, and shall, submit a certi- fied copy of this Resolution to: The Marin County Board of Supervisors, the City of San Anselmo, the Marin Local Agency Formation Commission, and Mr. Edward Freitas. PASSED AND ADOPTED by the City Council of the City of San Rafael on this 20th day of October, 1975, by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None MARION A.
