RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AMENDING RESOLUTION NO. 1567, SECTION 9 THEREOF RELATING
TO THE SALE OF SURPLUS PROPERTY OF THE CITY OF SAN RAFAEL.
WHEREAS, on the 14th day of April, 1955, the City Council of the City
of San Rafael, did by resolution adopt Resolution No. 1567 implementing the
provisions of subdivision (i) of Section 2 and Sections 5 and 6 of Charter
Ordinance Number 423; and
WHEREAS, Section 9 thereof creates an uncertainty as to the sale of
surplus property; and
WHEREAS, it is the intent of the City Council by this resolution to clarify
Section 9 by amending same to read as follows:
NOW, THEREFORE, BE IT RESOLVED that Section 9 shall read:
"Section 9. SURPLUS STOCK. The sale of any surplus supplies,
materials and/or equipment, or any supplies, materials and/or equipment
which have become obsolete, worn out, unusable, or no longer needed or
suitable for the public use shall be sold under the direction of the City Mana-
ger. Said surplus supplies, materials and/or equipment may be sold at public
auction or by bid for the best price available. The City shall have the right
to refuse any bid, whether obtained at public auction or privately.
I, MARION A. GRADY, Clerk of the City of San Rafael, hereby certify
that the foregoing Resolution was duly and regularly introduced and adopted
at a regular meeting of the Council of said City held on the l s day of
Apr i 1 , 1974, by the following vote, to -wit:
AYES: COUNCILMAN: Jensen, Miskimen, Mulryan, Nixon and Mayor
Bettini
NOES: COUNCILMAN: None
