SUBJECT: Resolution approving a fee waiver request for planning permits to operate a temporary
rotating emergency shelter for the homeless at five churches: Vineyard Christian Fellowship Church (809
B Street), San Rafael United Methodist Church (9 Ross Valley Drive), First Presbyterian Church (1510 51h
Avenue), Christ Presbyterian Church (620 Del Ganado) and Unitarian Universalist Church of Marin (240
Channing Way); File No. P09-016.
RECOMMENDATION: That the City Council adopt the attached Draft Resolution.
BACKGROUND: This item was presented to the City Council on October 5, 2009. Four churches in San Rafael,
Vineyard Christian Fellowship Church, San Rafael United Methodist Church, First Presbyterian Church and Christ
Presbyterian Church, were each proposing to operate an open shelter program for the homeless. The churches
are part of a collaborative effort with St. Vincent de Paul Society to establish a rotating open shelter program with
churches throughout Marin County. No Planning applications have been submitted to date. Since this Council
meeting date a fifth church, the Unitarian Universalist Church of Marin located at 240 Channing Way has filed a
fee waiver request (see attached) to participate in the rotating shelter program.
Prior to the hearing, the City Manager received a commitment from the Marin Community Foundation (MCF) to
contribute $4,000 towards each of the applications. The churches would have to make the request for these
funds directly to MCF. The City Council action on October 5, 2009 was to grant the fee waiver requests beyond
any funds provided by MCF, and to direct staff to prepare a resolution to this effect for City Council adoption. The
attached resolution would waive processing fees for each application beyond $4,000, the amount offered by MCF,
if the churches wish to take advantage of that offer.
FISCAL IMPACT: As indicated in the October 5`h staff report, planning fees for Planning Commission level Use
Permits are cost -recovery fees. An initial deposit amount is submitted that is intended to cover approximately 70%
of the typical application of that type and level and any costs above the initial deposit amount would be billed to an
applicant. Therefore in this case, the fee payment of $4,000 for each church would generally cover the initial
deposit and the fee waiver would waive any additional fees above the initial deposit.
OPTIONS: The following options may be considered by the City Council on this matter:
1. Adopt the Resolution as drafted (staff recommendation); or
2. Adopt the Resolution with further modifications

RESOLUTION OF THE SAN RAFAEL CITY COUNCIL WAIVING PAYMENT OF
FEES FOR UP TO FIVE USE PERMIT APPLICATIONS REQUESTING APPROVAL
FOR TEMPORARY HOMELESS SHELTERS AT VINEYARD CHRISTIAN
FELLOWSHIP CHURCH (809 B STREET), SAN RAFAEL UNITED METHODIST
CHURCH (9 ROSS VALLEY DRIVE), FIRST PRESBYTERIAN CHURCH (1510 FIFTH
AVENUE), CHRIST PRESBYTERIAN CHURCH (620 DEL GANADO) AND
UNITARIAN UNIVERSALIST CHURCH OF MARIN (240 CHANNING WAY)
WHEREAS, City Council Resolution 11025 (policy for consideration of fee waiver requests
for planning and building permits) sets forth procedures for waiving planning application fees
from non-profit applicants providing services to low-income persons up to $2,000 and gives the
City Council discretion for granting fee waiver requests in excess of the $2,000 maximum; and
WHEREAS, on September 25, 2009, the Vineyard Christian Fellowship Church, San Rafael
United Methodist Church, First Presbyterian Church and Christ Presbyterian Church, submitted a
letter requesting a fee waiver of all planning fees relating to securing Use Permits to operate an
open rotating shelter program for the homeless; and
WHEREAS, on October 15, 2009, the Unitarian Universalist Church of Marin submitted a
letter requesting a fee waiver of all planning fees relating to securing a Use Permit to operate an
open rotating shelter program for the homeless; and
WHEREAS, the Marin Community Foundation offered to contribute $4,000 for each Use
Permit application upon a request for the funds from each church; and
WHEREAS, on October 5, 2009, the City Council considered and discussed the proposed
fee waiver item, accepting the written report of the Department of Community Development and
public comment; and
WHEREAS, at its October 5, 2009 meeting the City Council unanimously supported the
waiver of planning application fees for use permit applications beyond the $4,000 offer made by
the Marin Community Foundation for each application, subject to requests being made to the
Foundation by the churches; and
NOW, THEREFORE BE IT RESOLVED that the City Council of San Rafael hereby
waives all Use Permit application fees beyond $4,000 for each of the following churches:
Vineyard Christian Fellowship Church, San Rafael United Methodist Church, First Presbyterian
Church, Christ Presbyterian Church and Unitarian Universalist Church of Marin; and
NOW BE IT FURTHER RESOLVED that this fee waiver is a one-time exception from
Resolution 11025 for Use Permit planning applications received from Vineyard Christian
Fellowship Church, San Rafael United Methodist Church, First Presbyterian Church, Christ
Presbyterian Church and Unitarian Universalist Church of Marin between October 1, 2009 and
December 1, 2009; and
I, ESTHER BEIRNE, Clerk of the City of San Rafael, hereby certify that the foregoing
Resolution was duly and regularly introduced and adopted at a regular meeting of the City
Council of the City of San Rafael, held on Monday the 19`h day of October 2009, by the following
