SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL APPROVING
THE APPLICATION FOR GRANT FUNDS FOR THE PER CAPITA GRANT PROGRAM UNDER THE
CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND COASTAL
PROTECTION ACT OF 2002 FOR FALKIRK CULTURAL CENTER HISTORICAL PAINT PROJECT
RECOMMENDATION: Approve Resolution
BACKGROUND: The Falkirk Cultural Center Historical Paint Project is an element of a plan to
systematically address the deterioration of the mansion, a result of age and extensive use, to maintain it
as a safe and serviceable facility while preserving its historic integrity. The priority elements of the plan,
resulting from a 2003 infrastructure assessment call for addressing those conditions that accelerate the
deterioration of the building, including eliminating moisture intrusion. In 2007 a majority of the roof was
replaced. The needed repairs to siding were completed in the summer of 2008.
The City has applied twice to the California Cultural Historic Endowment for funding to address the entire
infrastructure upgrade needs. Neither grant application met with success.
In November of 2008 the San Rafael City Council met jointly with the Park and Recreation Commission to
prioritize facility improvement projects, applying specific grant and earmarked development fees. The
consensus was this project, applicable for State grant funding, was critical among other park and
recreation facility needs for the enduring security of the historic building. The mansion was last painted
approximately fifteen years ago.
The City was allotted funds on a per capita basis from the 2002 California Clean Water, Clean Air Safe
Neighborhood Parks and Coastal Protection Act of 2002. Funds from this program have been applied to
several park renovation projects. $148,803 remains to be allocated to the City of San Rafael.
ANALYSIS: This project proposes the painting of the exterior of the mansion/Center to make the outside
envelope of the structure water tight, protecting the historical mansion and its contents. Kunst Brothers
Painting and Contraction submitted a bid for the work and reconfirmed the original amount recently. The
local painting company offers expertise in treatments for Victorian style homes. The paint shall be
carefully replaced with the current color scheme, and the bricks water sealed. Protection is the goal of
the project. Secondarily, the esthetic improvement will also have impact as fading and peeling has
occurred in different stages at various locations around the building.

FISCAL IMPACT: There is no fiscal impact to the City for this project other than staff resources to
manage the contract. The expenditure of funds, $99,262.00 from the Per Capita Grant will leave the City
with $49,541 in allocation to be spent by June 2011.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE PER CAPITA
GRANT PROGRAM UNDER THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE
NEIGHBORHOOD PARKS, AND COASTAL PROTECTION ACT OF 2002 FOR
FALKIRK CULTURAL CENTER HISTORICAL PAINT PROJECT
WHEREAS, the people of the State of California have enacted the Per Capita Grant
Program which provides funds for the acquisition and development of neighborhood,
community, and regional parks and recreation lands and facilities; and
WHEREAS, the California Department of Parks and Recreation has been delegated
the responsibility for the administration of the grant program, setting up necessary
procedures; and
WHEREAS, said procedures established by the California Department of Parks and
Recreation require the Applicant's Governing Body to certify by resolution the approval
of the Applicant to apply for the Per Capita Allocation, and
WHEREAS, the City of San Rafael will enter into a Contract with the State of
California for the Falkirk Cultural Center Historic Paint Project;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Rafael hereby:
1. Approves the filing of an Application for local assistance funds from the Per
Capita Grant Program under the California Clean Water, Clean Air, Safe
Neighborhood Parks, and Coastal Protection Act of 2002; and
2. Certifies that the Applicant has or will have sufficient funds to operate and
maintain the Project; and
3. Certifies that the Applicant has reviewed, understands and agrees to the General
Provisions contained in the Contract shown in the Procedural Guide; and
4. Appoints the City Manager as agent to conduct all negotiations, execute and
submit all documents including, but not limited to Applications, agreements,
payment requests and so on, which may be necessary for the completion of
Project.

foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the City Council of said City held on Monday, the 15th day of June, by the
