SUBJECT: A RESOLUTION SETTING THE SPECIAL ASSESSMENT TAX RATE FOR
YEAR 2009-10 ON ALL TAXABLE PROPERTY WITHIN THE COMMUNITY
FACILITIES DISTRICT NO. 1992-1 (LOCH LOMOND #10)
RECOMMENDATION: ADOPT RESOLUTION SETTING ASSESSMENT TAX RATES
FOR THE LOCH LOMOND DISTRICT FOR FISCAL YEAR 2009-
10
BACKGROUND:
When the City Council and landowners worked to establish the Community Facilities District
1992-1 (more commonly known as Loch Lomond #10), the Council also took steps to approve
the creation of a special tax to support the necessary operating costs and reserves. The
special tax is collected to set up a self-insurance liability reserve and to provide monies for
administrative, maintenance and incidental expenses associated with operating the District.
Each year, staff reviews and prepares a formal resolution setting the special tax rates. Action is
required by the City Council in order to levy the taxes against the District properties.
ANALYSIS:
As is consistent with each year, staff has calculated the tax based upon established formulas.
The Council approved Ordinance No. 1683 several years ago which provide that the tax rate be
set by resolution subject to the formulas in Resolution 9648. Based upon the formulas, staff is
recommending a rate of $554 for each of the 27 assessable parcels. This is an increase of
$6.00 per parcel over the previous year rate of $548 each. The increase is a combination of
increases for future maintenance activities and for maintaining fire and drainage access. The
funding for the self-insurance reserve has remained intact with a balance of $500,000.
Maintenance activities increased based on the percentage increase in the consumer price index
— all urban consumers in the San Francisco -Oakland -San Jose, CA area (0.80 percent). The
percentage increase applied to last year's base amount of $414 per parcel for future
maintenance activities equals $417, which adds $3 per parcel for those expenses. Additionally,
there is an annual 2.0 percent added to a separate base amount of $134 for maintaining fire
and drainage access. This adds an additional $3 per parcel to the fund to a total of $137.

The self-insurance set aside amount assessed in the prior years was $1,852 per parcel per
year. The maximum reserve requirement of $500,000 was reached in June 2005. Therefore,
no amounts for the self-insurance set-aside will be levied until the fund is tapped with a valid
claim.
The total levies will generate $14,958 in taxes. Although the self-insurance set-aside has
reached the maximum and will no longer be levied until a valid claim reduces the reserve, the
assessments for maintenance activities and for fire and drainage access expenses will continue
to be levied.
FISCAL IMPACT:
The tax levies have been estimated in developing the budget for Fiscal Year 2009-10. This
action is necessary in order to provide the County Auditor Controller the necessary
documentation to initiate Fiscal Year 2009-10 Loch Lomond levies. A full listing of the parcels
levied is attached to this report. A Resolution has been prepared which establishes Fiscal Year
2009-10 rate at $554 per parcel. No fiscal impacts occur to the City's General Fund by taking
this action.
ACTION REQUIRED:
Staff recommends the City Council approve the report and adopt the Resolution as presented.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL SETTING THE SPECIAL ASSESSMENT DISTRICT TAX FOR
LOCH LOMOND #10 FOR FISCAL YEAR 2009-10 AT $554 PER
PARCEL, EXCEPTING EXEMPT ASSESSOR PARCEL NO'S. 16-330-
12,13,14.
WHEREAS, the City Council of the City of San Rafael by Resolution No. 8839
formed "Community Facilities District No. 1992-1 Loch Lomond #10", City of San Rafael,
County of Marin, State of California, and,
WHEREAS, the landowners of CFD 1992-1 voted in a mail ballot election called by
the City Council by Resolution No. 8840, and unanimously approved the imposition of a
special district tax, as declared in Resolution 8841; and,
WHEREAS, on March 9, 1993, the City of San Rafael prepared and filed a Notice
of Special Tax Lien for all of the parcels within the CFD 1992-1, which included the
facilities and services to be funded by the tax, and method for establishing a rate and
calculating the apportionment of the tax; and
WHEREAS, Ordinance 1683 provides that the rate will be set by resolution subject
to the maximum authorized by Resolution 8839.
NOW THEREFORE BE IT RESOLVED that the City Council of San Rafael does
hereby set the special district tax for Loch Lomond #10 at $554 per parcel for fiscal year
2009-10 excepting exempt Assessor Parcel No's. 16-330-12,13,14, as provided in Exhibit
"A", attached hereto and incorporated herein.
