SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING
THE CITY MANAGER TO SHARE IN THE COST FOR A CONSULTANT TO STUDY THE FIRE
PROTECTION AND EMERGENCY RESPONSE SERVICE DELIVERY BETWEEN THE CITY OF SAN
RAFAEL AND THE MARINWOOD COMMUNITY SERVICES DISTRICT
RECOMMENDATION: Adopt the Resolution authorizing the City Manager to share in the costs of the
study.
BACKGROUND: On November 4, 1979 an agreement between the City of San Rafael and the
Marinwood Community Services District was signed, establishing a Marinwood response to certain
portions of the City in exchange for:
a) a full City response to structure and wildland fires in Marinwood,
b) dispatching services by the City for Marinwood, and
c) an annual payment from the City to Marinwood.
The original agreement has been altered twice in the ensuing years, changing the amount of City area
into which Marinwood responds, and the cost for these services. In the current budget year, the costs to
the City are $275,000.
The most recent agreement, signed in June of 2006, stated that the City and Marinwood were both willing
and would explore alternative means of delivering fire protection and other emergency response services
to the San Rafael and Marinwood service areas, including regionalization or consolidation of services
prior to the expiration of the agreement. The current agreement expires on June 30, 2009.
ANALYSIS: City staff has been in discussion with Marinwood regarding the study. Marinwood will be the
lead agency in the study. Conditional on the City's concurrence to share in the costs, the Marinwood
district board has hired a consulting firm, at a total cost of $44,000, and approved payment for the
district's one-half portion. The present resolution provides authorization of payment for San Rafael's one-
half portion of the cost of the Fire Service Delivery Study.
FISCAL IMPACT: The cost to the City of San Rafael is $22,000.00

AUTHORIZING THE CITY MANAGER TO SHARE IN THE COST FOR A
CONSULTANT TO STUDY THE FIRE PROTECTION AND EMERGENCY
RESPONSE SERVICE DELIVERY BETWEEN THE CITY OF SAN RAFAEL AND
THE MARINWOOD COMMUNITY SERVICES DISTRICT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES:
WHEREAS, the CITY OF SAN RAFAEL (hereinafter "CITY"), and the MARINWOOD
COMMUNITY SERVICE DISTRICT (hereinafter "DISTRICT") have had a Agreement in place since
November 5, 1979 for mutual response; and
WHEREAS, the CITY and the DISTRICT altered the terms of the agreement to change the financial
terms on April 6, 1998; and
WHEREAS, the CITY and the DISTRICT altered the financial terms of the agreement again and
agreed to study fire protection and emergency response service delivery in the area on June 19, 2006; and
WHEREAS, the June 19, 2006 agreement stated that the service delivery study would be done during
the agreement period, which ends on June 30, 2009; and
WHEREAS, the CITY agreed to let the DISTRICT be the lead agency in securing a firm to produce
the service delivery study, and also agreed that the CITY would pay for one-half of the costs; and
WHEREAS, the DISTRICT has presented the CITY with the firm chosen and the costs
NOW, THEREFORE, the MAYOR and CITY COUNCIL, this 16`h day of March 2009, authorize the
City Manager to share equally in the costs for a consultant to study the fire protection and emergency response
service delivery between the CITY and DISTRICT, and that the CITY's portion of these consultant costs are
$22,000.00
