ON THE SAN RAFAEL FIRE COMMISSION, DUE TO THE EXPIRATION OF TERM OF

RECOMMENDATION:
It is recommended that the City Council interview the following applicant to fill one, four-year term on the
San Rafael Fire Commission, with term to expire the end of March, 2012.

SUMMARY BACKGROUND:
At the meeting of February 19, 2008, the City Council called for applications to fill one, four-year term to
the end of March, 2012, due to the expiration of term of Charles Daniels, Jr. The deadline for receipt of
applications was set for Tuesday, March 11, 2008 at 12:00 noon. Mr. Daniels has expressed interest in
serving another term, and his was the only application received in the City Clerk's Office by the deadline.

FIRE COMMISSION
APPLICATIONS to serve on the Fire Commission, City of San Rafael, to fill one, four-year
term to the end of March, 2012, may be obtained at the City Clerk's Office, City Hall, 1400 Fifth
Avenue, Room 209, San Rafael. The deadline for filing applications is Tuesday, March 11,
2008, at 12:00 noon, in the City Clerk's Office.
There is no compensation paid to Fire Commissioners. Members must comply with the Cites
ethics training requirement of AB 1234, and reimbursement policy. See attached information.
ONLY RESIDENTS OF THE CITY OF SAN RAFAEL MAY APPLY.
The Fire Commission regularly meets on the second Wednesday of every month at 7:00 p.m. at
San Rafael Fire Station # 1 at 1039 C Street.
Interviews of applicants will be held at a Special Meeting of the San Rafael City Council on
Monday, March 17, 2008, commencing at 6:00 p.m., to fill one, four-year term to the end of
March, 2012.
An excerpt from the San Rafael Municipal Code re: Fire Commission membership, terms of
Commission members, powers and duties, etc., is also attached.

SAN RAFAEL CHARTER
ARTICLE VIII Executive and Administrative Departments, Section 10. FIRE COMMISSION.
There shall be a board of fire commissioners appointed by the council, the exact number of which shall
be set by ordinance or resolution of the council, one of whom may be a councilman. The chief of the fire
department shall be an ex officio member of the commission but shall not be entitled to vote as a member
of the commission. The members of the commission shall serve for a term of four years and shall be
subject to removal by the affirmative vote of three members of the council. The terms of office of members
of the commission shall be staggered in the manner provided by resolution of the council. The board of fire
commissioners shall exercise such powers and perform such duties as may be prescribed or conferred in
this charter or by the ordinances of the city. (Assembly Concurrent Resolution No. 121, August 20, 1973:

2.16.010 Board of Fire Commissioners.*
A board of fire commissioners is created. (Ord. 889 § 2, 1967: Ord. 825 § 1, 1965: Ord. 422).

2.16.011 Board membership --Compensation.
The board of fire commissioners shall consist of five members appointed by the city council, one of whom
may be a councilman. The chief of the fire department shall be an ex officio member of the commission,
but shall not be entitled to vote as a member of the commission. All members of the commission shall
serve without compensation. (Ord. 889 § 3 (part), 1967).
2.16.012 Board term of office and removal.
The members of the board of fire commissioners shall serve for a term of four years and shall be subject
to removal by the affirmative vote of three members of the council. The terms of office of members of the
commission shall be staggered in the manner provided by resolution of the city council.

2.16.013 Board powers and duties.
Subject to the direction and control of the city council, as provided in Section 2.04.030 of this code, the
powers and duties of the board of fire commissioners shall be:
To review and recommend concerning the future needs of the fire department in respect to long-range
capital needs, including buildings, training facilities, and water mains and hydrant replacements;
To review the relationship of the fire department with other governmental agencies and private entities
concerning topics which the commission feels present a true and pressing need for the city's fire service,
i.e., mutual aid and the fire rating system of the Independent Insurance Office;
To review, comment and make recommendations regarding the annual operating budget of the department;
To recommend to the fire chief and the city council action concerning initial adoption and future
amendments to the fire prevention code, the building code, and other such ordinances which pertain to the
prevention of fires within the community;
To receive monthly reports from the department head concerning the general operations and functions of
the department;
To perform such other duties as may be prescribed by the city council.

Dear Mayor and Members of the City Council
It is my pleasure to again apply for and to continue my service as a Fire
Commissioner in the City of San Rafael.
For the past 14 years I have served on the Fire Commission, the last 10 years as
Chairman.
have enjoyed watching the department grow in professionalism and stature in
our community and the State of California. As we know, our department is
considered one of the top departments in the state in the area of community
service, and is the pride of our city.
In 1990 our department responded to 4781 calls averaging 13 calls per day. In
2003 we responded to almost 6600 calls averaging 18 per day, a 38% increase.
We now have a new young Fire Chief with a very impressive resume. I am sure
that his knowledge and enthusiasm will bring us to even higher acclaim from our
peers in County and State.
My wish would be to work with the new Chief and help the commission assist him
in any helpful way.
My own background of over 50 years involvement in the public safety field for the
City of San Rafael and the County of Marin hopefully will be of some assistance
to our new E ief.

P.S. I have taken the liberty of submitting a brief summary of my past activities in
the field of Public Safety.

Past activities relating to the fire service, law enforcement and public safety in
general:
1942 Joined San Anselmo Fire Department as an active volunteer under
Chief Nello Marcucci.
Presently a "life -time honorary"member of San Anselmo Fireman's
Association (now Ross Valley).
1945 Joined Ross Fire Department as an active volunteer under Chief
Harold Heinrichs.
1949 Instituted first county -wide Fire Prevention Week through the
Marin Junior Chamber of Commerce to impress citizens and school
children with fire safety to coordinate all Fire Departments in the
County in common interest.
1950 Initiated a Bureau of Fire Investigation for the County of Marin
under the then District Attorney, Albert E. Bagshaw, Sheriff Walter
Sellmer, San Rafael Police Chief Frank Kelly, Fire Chiefs Fritz
Johansen, San Rafael; Nello i'vTarcucci, San Anselmo; Matts Perry,
Sausalito; Camillo Mello and Chairman Walter Castro, Sr., Board of
Supervisors.
1950- The only Northern California law enforcement officer to attend two
1951 sessions of Purdue University's International Arson Investigator's
Seminar staffed by the FBI, RCMP, CIA and Naval Intelligence.
1951 Trained actively with the San Francisco Arson Squad under San
Francisco Chief Frank Kelly. Trained with the Los Angeles Arson
Squad.
Worked in cooperation with agents of the National Board of Fire
Underwriters fire and jewel theft investigative team.

Conducted arson investigations for the fire departments, District
Attorney's office, Sheriff's office and police departments of Marin County
Some of the major investigations:
1950: Fire Warden cases: A conspiracy of fire personnel setting major
bush and building fires to create jobs, excitement and volunteer payments.
1951: San Quentin Prison jute mill fire
San Rafael Military Academy fire threatened 34 students in
dormitory. Set by a disturbed student and convicted arsonist.
1952: San Rafael Lodge fire -12 deaths - suspected homicides
Marshall, Blue Baie Tavern fire. (Malcolm Schlette convicted)
1957 Fourth Street (between D and E Street) fire in San Rafael. Major
Destruction of business and office buildings. Set by juveniles in
a paint warehouse.
Served on the California Crime Commission during the term of Governor
Ronald Reagan.
