RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL ADOPTING IN PRINCIPAL AN OPEN SPACE PLAN
WHEREAS, in 1970, the State Legislature passed and the Governor
signed into law, AB 2180 requiring that "Every City and County shall, by June
30, 1972, prepare and adopt a local open -space plan for the comprehensive
long range preservation and conservation of open space within its jurisdiction",
and
WHEREAS, the City has authorized the funds and staff necessary
for the preparation in proper depth and detail of said general plan element;
and
WHEREAS, said undertaking if properly performed will require
more time than the law permits; and
WHEREAS, formal planning studies were undertaken with federal
701 and County funds to prepare a Countywide General Plan containing an open
space element and many hearings have been held on said plan;
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. That the City will diligently pursue the preparation and
adoption at a later date when completed a detailed and open space element
localized to San Rafael; and furthermore,
2. That the City of San Rafael now adopts in principal as its
open space element, pursuant to State Law, the policy of designating for
open space uses all lands in the City which are both in open space uses at
the present time and also designated in the Preliminary Marin Countywide
Plan as "Urban Open Space".
It shall also be the City's policy in any proceedings for the acquisition of
such open space that first priority shall be given to lands in the designated
areas which are on the bay shoreline or on ridges separating communities.
I, MARION A. GRADY, Clerk of the City of San Rafael, Cali-
fornia, hereby certify that the foregoing resolution was duly and regular-
ly introduced at a regular meeting of the Council of said City
held on the 15th day of May , 1972, by the following vote, to -wit:

NOES: COUNCILMEN: Jensen and Mayor Bettini
ABSENT: COUNCILMEN: None
