RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL RE ANNEXATION OR CONSOLIDATION OF THE TERRA
LINDA COMMUNITY SERVICES DISTRICT WITH THE CITY OF
SAN RAFAEL.
WHEREAS, the City Council of the City of San Rafael and the
Board of Directors of the Terra Linda Community Services District
have held public hearings to determine the feasibility of annexing
or consolidating Terra Linda Community Services District with the
City of San Rafael; and
WHEREAS, pursuant to said meetings and pursuant to a meeting
held on July 20, 1972, between members of the City Council and the
Board of Directors of Terra Linda Community Services District, a
certain Memo of Understanding was entered into, a copy of which is
attached hereto and marked Exhibit A; and
WHEREAS, it has been mutually agreed that the area comprising
Terra Linda Community Services District as set forth on the map
attached hereto and marked Exhibit B, should be a part of the City
of San Rafael.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael desires, agrees and recommends that the area
comprising Terra Linda Community Services District, as set forth
in the map attached as Exhibit B, should be annexed or consolidated
with the City of San Rafael upon the terms and conditions so far as
they are legally possible as set forth in Exhibit A attached hereto.

certify that the foregoing Resolution was duly and regularly intro-
duced and adopted at a reuilar meeting of the Council of said City
held on Monday, the 24th da_v of July, 1972, by the following vote,
to wit:

CONTENTS OF PETITION FOR ANNEXATION -TERRA LINDA COF1MlJId[TY SERVICES DISTRICT
On Thursday evening July 20th, Messers, Less, Mulryan and Bielser met to reduce
to waiting the understanding reached by the CSD Board of Directors and the City
Council which will be incorporated in the annexation petition required by the
Local Agency Formation Commission. The basic provisions of the understanding
are enumerated below:
FIRE STATIOi? - City agrees to construct a new fire station in the area generally
west of Las Gallinas Road and on the north of Freitas Parkway in the immediate
vicinity of the Terra Linda Community Services District.
ASSU;;PTIO1 OF DISTRICT PERSOJNEL - City agrees to assume present District Personnel
as indicated herein with no reduction in salary:

Present CSD part time personnel will be employed wherever feasible in the opinion
of the City tanager. All District employees be accorded all City fringe bene-
fits and will be subject to all City and departmental personnel rules and regu-
lations. ASsign,;,ent of duties will be the perogative of the City, however, no
reduction in above salaries will result.
A N!EXATIOiI FEE - There will be no annexation fee.
POLICE PROTECTI91 - City agrees to provide the level of police protection propor-
tionate to the needs of the area to be annexed.
EXPANSION OF COMI ISSIONS - City agrees, upon annexation to expeLnd Parks and Recre-
ation and Fire Commissions from present five to seven members. Appointments shall
be made from the Las Gallinas Valley provided that one each shall be appointed
fro, residents of the Terra Linda Community Services District.
ASSUMP-iION OF DISTRICT ASSETS - Upon annexation all District lands, improvements
and e-uip-ant and maintenance of sane shall be vested in the City of San Rafael.
CSD agrees to transfer title of same to the City of San Rafael.

PRE -ZONING - City agrees to prezoning of CSD area to present zoning.
BONDED INMECTED'IESS - (a) City agrees to exempt CSD taxpayers from that portion
of the City tax rate required for City sevier bonds.
(b) CSD agrees that its taxpayers will, upon annexation,
assun;-Z that portion of the City tax rate required to service open space acquisition
bonds if approved by San Rafael voters on September 19, 1972.
(c) City agrees to assume full servicing of all CSD bonded
indebtedness.
Al�'.E.Xr�TION ELECTIO'I - It is agreed that every effort should be made to consolidate
the annexation election with the 1972 November General election. Annexation to
beco-e effective on January 1, 1973.
Sl!I?'."11j1G POOL - City and District agrees that CSD Swimming Fool will be maintained
o;i an open access basis subject to appropriate use charges as determined by the
City Council.
DISPOSITI0;1 OF DISTRICT RESERVE - First call upon all district reserve funds shall
be for the acquisition of open space.
The foregoing is believed to generally represent the understanding reached between
the Board of Directors and the City Council. As noted above, it will be necessary
to incorporate the understanding into the annexation petition. Please review the
contents of the understanding. Your reactions would be appreciated as soon as
possible.
In the meantime,.a hearing on the annexation has been set by the Local Agency Com-
mission for August 7, 1972 at 5:00 p.m. in the Board of Supervisors' Chamber.
