RESOLUTION NO.
A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RE-
SOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute,
on behalf of the City of San Rafael a lease or agreement with
Joint Powers Agreement between the Marinwood CSD and the City of
San Rafael regarding mutual assistance ,
a copy of which is hereby attached and by this reference made
a part hereof.
I, MARION A. GRADY, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and re-
gularly introduced and adopted at a regular meeting
of the Council of said City held on Monday _ the 2nd
day of July 197_, by the following vote, to -

THIS AGREEMENT, made and entered into this ',,�-';dav of
1973, by and between MARINWOOD
COMMUNITY SERVICES DISTRICT, hereinafter referred to as
"DISTRICT", and the CITY OF SAN RAFAEL, a municipal corporation,
hereinafter referred to as "CITY".
W I T N E S S F T H:
r.HEREAS, Title 1, Division 7, Chapter 5 of the California
Government Code provides for joint rowers agreements between
public bodies; and
WHEREAS, it is in the mutual interests of the parties
'-,ereto to enter into an agreement to provide for the mutual
fire protection of certain areas of the Citv anc2 of District;
NOW, THEREFORE, in consideration of the mutual promises anC
covenants hereinafter contained, the parties hereby aqr-c ,s
follows:
CITY agrees to:
1. Provide a "standby" fire enaine and crew to District.
Said standby engine will be not morn than one and one-half (1-1/2)
miles from the District's station and City agrees to use its
Engine No. 3 whenever possible. The standby engine and its
ecuipment will meet or exceed the following requirements:
300 gallon water tank
500 gallon per minute pump
1,200 ft. 2-1/2" and 3" line
(combined)
35' extension ladder (1)
12' roof ladder (1)
2. Dispatch two (2) engine companies and one (1) truck
company to all structural fires within the agreed area of City
north of Montevideo Way and illustrated in Txhibit A attached hereto.
The first engine company will respond directly to the scene of
the emergency. The second company will proceed directly to
District fire station. Truck company will respond directly
to the scene of the emergency.
3. In the event that a fire engine of District is taken out
of service for an annual pump test, mechanical failure, overhaul,
or for other reasons, City will furnish on loan to District
a "reserve" engine for use while their engine is out of
service. However, in no event shall this time be in excess
of seventy-two (72) hours unless additional time is agreed upon
by the Fire Chief of District and City. The equipment require-
ments and engine capabilities for the "reserve" engine will
be the same as those set forth for the "standby" engine
defined in Paragraph No. 1.
4. Provide mutual aid response to District when requested
by District within City's capabilities of available manpower
and equipment.
5. Citv's Engine Company No. 3 or other available
equipment meeting the standards for the "reserve" engine
set forth in this agreement will respond to District's
station on all resuscitation and first aid calls enanatina from
City to District.
DISTRICT agrees to:
1. Respond on a "first -in" basis on all structure fires
to those areas of City north of f4ontevideo Way and set forth
in Exhibit k attached hereto. District's obligation to respond
as indicated herein will occur only at the request of City's
Fire Chief, the Chief -in -Charge, or Fire Department Dispatcher.
2. On resuscitation and first aid responses, the District
will respond on a "first -in" basis upon notification by Cit_v
in those areas of City north of Montevideo Way and set forth
in Exhibit A attached hereto.

3. All responses by District will be made within the
capabilities of its available manpower and equipment.
IT IS FURTHER AGREED:
1. District and Citv will participate jointiv on a monthly
basis in a training program at a time and place to be designated
by the Fire Chiefs of District and City.
2. In cases where District utilizes the training facilities
at San Rafael Station #¢2, an engine company and crew from City
will be dispatched to District station to Provide cover in
service to District and other areas under jurisdiction of
District.
3. City hereby holds District, its officers, agents,
servants and employees, while acting as such, free and harmless
from any liability from any obligations arising by virtue of
law, because of injury to property or injury or death of persons
received or suffered by reason of anv actions of Citv under the
provisions of this Agreement.
4. District holds City, its officers, agents, servants
and employees, while acting as such, free and harmless from any
liability from any obligations arising by virtue of law,
because of injury to property or injury or aeath of persons
received or suffered by reason of any actions of District
under the provisions of this Agreement.
5. This Agreement may be amended or terminated by the
mutual consent of the parties hereto and may be cancelled by
either party upon ninety (90) days notice in writing.
IN WITNESS WHEREOF, the parties have executed this Joint
Powers Agreement this 2nd day of July , 1973.
