THE SUBllItiTSION OF THE CITY OF SAN RAFAEL, �UkRIN
COUNTY, CALIFORNIA, BY ADDING SUBSECTION l.i.l,
RELATIP:G TO THE PURPOSE, OF SAID ORDINcANCE; BY PIAENDING
SUBSECTION 2.3 DEFINING ''SUBDIVIDER"; BY AMENDING
SUBSECTION 2.4 DEFINING A SUBDIVISION; BY AMENDING
AND ADDING TO SECTION III AS IT RELATES TO THE PRO-
CEDURE FOR THE FILING AND APPROVAL OF TENTATIVE MAP
OF A SUBDIVISION OF FOUR OR LESS LOTS; BY ADDING
SUBSECTION 3.23.08 REQUIRING AN AREA PLAN TO ACCOP P1 ',ICY
A TENTATIVE MAP- BY ADDING SUBSECTION 6.22.1 RELA'C T Ne -I
TO THE IIL1PROv&!EEY7T OF UNIMPROVED STREETS UNDER CERTAIN
CONDITIONS; AND BY ADDTNG SUBSECTION 6.31 REQUIRING
INSTALLATION OF STREET SIGNS.
T=ie City Council of the City of San Rafael do ordain as
follows:
SECTION I: Subsection 1.1.1 is hereby added to Section
i of Charter Ordinance No. 546, to read:
1.1.1 This ordinance is also enacted to pro-
vide for the division or subdivision of any
parcel of land in the City of San Rafael into
two, three or four parcels of land.
'SECTION IT: Subsection 2.3 of Section II of Charter
Ordinance No. 546 is hereby amended to read:
2.3 "Subdivider" shall mean any individual,
.F=irm, association, syndicate, co -partnership,
corporation, trust or any legal entity com-
mcncinS proceedings under this Ordinance to
e -L a subdivision of land hereunder for
himself or for another, or who divides or
subdivides, or who causes,to be divided or
subdivided, any parcel of land in the City
of Sail. Rafael for himselL or for another.
While used herein in masculine gender and
singular number the term "subdivider" shall
be deemed to mean and include the feminine
or neuter gender and the plural number wtien-
ever required.
SECTION III: Subsection 2.4 of Charter Ordinance No.
5416 is hereby amended to read:
"Subdivision" shall mean any land, or Portion
thereof , shown on the last preceding ta_-, roll
as a unit, or as contiguous units, which is
divided for the purpose of transfer of owner-
ship, sale, lease, or any other purpose,
whether- i m-iediate or future, by any subdivider."

SECTION IV: Subsections 3.11.01 and 3.11.03 of Section
III of Charter Ordinance No. 5_'E6 are amended to read:
3.11.01 Four (4) copies of the tentative :nap
of the proposed subdivision of any sand into
(4) or less lots shall be filed with the Sub-
division Committee, and a filing fee of FIVE
(5) DOLLARS shall be paid therewith.
3.11.03 The Subdivision Committee shall
determine whether the proposed subdivision
is in conformity with law and this ordinance.
If the Subdivision Committee determines that
the purposes of this ordinance can be accomplished
without the filing of a final map of the sub-
division, the Subdivision Comittee may, by an
endorsement on the tentative map to that effect,
relieve the subdivider frora the requirement of
filing a final map of the subdivision. Approval
of the tentative nap shall be by vote of any
two members of the Subdivision Committee and
shal.i be noted by endorsement O.n tine tentative
map. One copy of the approved tentative map
shall be retained in the files of Planning
Commisssion. In all cases where a new public
street, or an extension of an existing public
street, is involved, a final map shall be filed.
SECTION V: Subsection 3."11.05 is hereby added to sub-
division 3.11 of Section III of Charter Ordinance No. 5461 to
read:
113.11.05 If the Planning Commission, upon
application of the subdivider, shall find the
facts set forth in subsections 7.11.01 - 7.11.032
inclusive, of Section VII of this ordinance, it
may approve access to the lots in the sub-
division over a private right of way; provided,
however, the subdivider shall first file with
said Planning Commission, for approval by it
and the City Engineer, a development plan
showing alignment, width, grade, and material
specifications of any proposed private right
of way, the topography and means of access to
each lot, and the drainage of the subdivisiong
and construction of such proposed private right
of way, as approved by the City Engineer, shall
be completed prior to completion of any.building
on any lot in the subdivision.
SECTION VI: Subsection 3.25.08 is hereby added to sub-
division 3.25 of Section III of Charter Ordinance No. 546, to
read:
3.25.08 An area plan at a scale of one inch
(1) equals three hundred feet (300), or larger,
snowing proposed streets, subdivision boundaries,
existing streets and property lines, in the

vicinity, which affect, or may be affected
by, the proposed subdivision.
SECTION VII: Subsections 6.22.1 and 6.31 are hereby
added to subdivision 6.2 of Section VI of Charter Ordinance
No. 546 to read:
6.22.1 Whenever a proposed subdivision, or a
proposed additional unit of an existing sub-
division, or any part thereof, does, or will,
front on a public street which has not been
improved to the standards required by this
ordinance, the subdivider shall, at his own
expense and to the standards -required by this
ordinance, improve to its full width, or
such part less than its full width as the

portion of said street upon which such front-
age does, or will exist, if the Planning
Commission, from a consideration of such pro-
posed subdivision, or such additional units,
tine present and future development of the
general area, present and potential popu-
lation factors affecting such subdivision
or additional unit and the neighborhood
generally, increased traffic, safety and
other needs of the proposed subdivision or
additional unit, and the welfare of the in-
habitants thereof and in the general neighbor-
hood, finds that such improvement of said
portion of such street, in accordance here-
with, as a condition precedent to the ap-
proval of any map required by this ordinance
of such subdivision, or additional unit, is
reasonably required for the protection of
the public health, safety and general welfare.
6.31 Street signs shall be installed at all
intersections when and as required and approved
by the City Engineer.
SECTION VIII: This Ordinance shall be published once in
full before its final passage in the INDEPENDENT -JOURNAL, a
daily newspaper of general circulation, printed, published and
circulated in the City of San Rafael, and shall be in full force
and effect thirty (30) days after its final passage.
