Mayor Boro announced in Open Session that the City Council would be going into Closed

4. RESOLUTION AUTHORIZING CONTRACT WITH RENAISSANCE RISK MANAGEMENT FOR WORKERS'

Councilmember Heller asked what the amount of the start-up costs will be and the
number and cost of the claims we process yearly. City Manager Nicolai explained that
Assistant City Manager Golt, who could answer those questions, is ill today, however,
she stated the answers would be provided no later than 1/6/95. Ms. Heller agreed.
Councilmember Heller moved and Councilmember Cohen seconded, to adopt a Resolution
authorizing an agreement with Renaissance Risk Management to provide Workers' Compen-
sation claims administration services.
RESOLUTION NO. 9281 - RESOLUTION AUTHORIZING AGREEMENT WITH RENAISSANCE RISK
MANAGEMENT TO PROVIDE WORKERS' COMPENSATION CLAIMS

5. DECLARATION OF VACANCY ON CITY COUNCIL AND CALL FOR APPLICATIONS TO FILL VACANCY
(CM) - File 9-1 x 9-4.1
Councilmember Cohen asked that the application period for the Council vacancy be
extended to January 20, 1995 (one week extension), and to schedule a special meeting
on January 30, 1995 to hold interviews. Mr. Cohen also suggested adding the following
three questions to the application form which would be in addition to those asked at
the time of the interview:
■ Why do you want to be considered for the position of City Councilmember?
■ What are the three major issues facing the City of San Rafael?
■ What is your vision for the City of San Rafael?
Councilmember Heller pointed out that the special meeting will be an open meeting.
She asked if the successful applicant would then assume duties at the February 6,
1995 meeting. Councilmember Cohen stated that is assuming the Council appoints a
candidate on January 30th.
Councilmember Cohen moved and Councilmember Heller seconded, to extend the applica-
tion period to S:OOPM Friday, January 20, 1995, schedule a special meeting for 7:OOPM
Monday, January 30, 1995 to interview the applicants and add to the application those
questions read earlier.

the City Council effective January 3, 1995.

VACANT EFFECTIVE JANUARY 3, 1995.

10. PUBLIC HEARING - APPEAL OF BUILDING OFFICIAL'S ENFORCEMENT OF SECTION 504 OF THE
UNIFORM BUILDING CODE AT 912 LOOTENS PLACE (PW) - File 1-6-1 x 9-3-40
Mayor Boro declared the Public Hearing opened.
Public Works Director Bernardi noted the Council is sitting as the Board of Appeals
regarding this issue. He stated that on December 14, 1994, the Zoning Administrator
approved a project for remodeling the building at 912 Lootens Place. He stated a new
store front was approved which is contiguous to the City property line. Currently,
Section 504 of the Uniform Building Code does not allow any openings on a property

line. Council is being asked to waive that section of the Uniform Building Code and
approve the openings subject to the conditions listed in the Resolution.
Mr. Bernardi stated the Redevelopment Agency has approved a similar proposal. Staff
recommends that the Council adopt a Resolution authorizing the penetration of the
property line by doorways and openings.
Mayor Boro noted the agenda indicates an appeal of building official's enforcement of
Section 504. He asked if, at the hearing, the official granted this based on
tonight's action. Mr. Bernardi clarified that the Zoning Administrator only approved
the zoning use of the building. As building official, Mr. Bernardi stated he will
not approve an opening on the property unless the Council approves it, noting Council
is being asked essentially to overrule his decision to not approve an opening on the
property line.
Mayor Boro asked if anyone in the audience would like to address the Council. As no
one wished to speak, Mayor Boro closed the Public Hearing.
Councilmember Cohen moved and Councilmember Heller seconded, to grant the appeal and
adopt the Resolution granting conditioned approval of an appeal from Section 504 of
the Building Code at 912 Lootens Place.

11. APPOINTMENT OF VICE MAYOR - File 9-1
Mayor Boro explained that due to the resignation of Councilmember Thayer, there is an
opening for Vice Mayor.
Councilmember Heller moved and Mayor Boro seconded, to appoint Councilmember Cohen as
Vice Mayor of San Rafael for 1995.
