SUBJECT: Recommendation for Community Development Block Grant (CDBG) Proposals
Funding Year 2011-12.
RECOMMENDATION: Adopt Resolution recommending Community Development Block Grant
project funding for the year 2011-12 to the Marin County Board of Supervisors.
BACKGROUND: In 1999, Council revised the Cooperation Agreement with the County of
Marin for CDBG funds. Under the agreement, the City remained in the County system, gained
the ability to allocate capital and. housing funds it would have received as a stand alone
jurisdiction, and left the public service recommendations and the overall administrative function
with the County. The Cooperative Agreement was revised and adopted in 2002, 2005 and
2008; it is due to be reviewed again later this year. In 1999, the City also adopted an
application process and allocation priorities, attached as Exhibit 1.
Under the adopted process, City staff reviews housing and capital applications and City Council
makes a recommendation to the Priority Setting Committee (one member from each City in the
County and a member of the Board of Supervisors). County staff evaluates the public service
applications and a Local Area Committee (one Council member and one member of the Board
of Supervisors), makes a recommendation to the Priority Setting Committee. The Priority
Setting Committee reviews the recommendations from each Planning Area and the City and
makes one recommendation to the County Board of Supervisors. It cannot change the
recommendation from the City. The decision to leave the public service recommendation with
the County was based on the City's desire to retain the County's expertise in balancing a large
number of applications with a limited amount of funds. The City also wanted to focus on larger
scale capital and housing projects, as was shown in the priority listing, which put City projects
first, followed by housing.
The San Rafael Local Area Committee meeting was held on March 10, and their funding
recommendation is in Exhibit 2. The Priority Setting Committee Meeting is scheduled for March
29 and the Board of Supervisors meeting is May 10, 2011. Projects which receive allocations
will then work with County staff to file the required environmental review, contracts and
certifications, and ultimately receive payment when the project is complete.

ANALYSIS:
Applications Filed
Nine applications for housing and capital projects were filed. A summary of the projects is
attached as Exhibit 3 and the applications are in Exhibit 4.
2010-11 Allocation Amount
The amount of the grant is not known at this time as HUD has not announced the grant amount
for the 2011-12 program year. In addition, there is considerable budget discussion at the
Federal level and the resulting impacts to the CDBG program ranges from complete program
elimination to cuts of 66% or continuation of last years funding level. County staff is basing their
grant amount planning for capital and housing on a 10% reduction from last year. This
uncertainty in grant amount has occurred for at least the last 10 years and has been handled
previously by making the grant amounts subject to revision on a proportional basis; that is, if the
total grant was 5% less than anticipated, each individual grant was reduced by 5%. Because of
the potential magnitude of the reduction this year, this approach is not feasible because
reducing individual grants by 66% or more would not give an applicant sufficient funds to
proceed. City and County staff recommend instead that Housing and Capital projects be
prioritized and funded at the amount requested in order of priority:
For the purposes of allocating funds, a County grant of 10% less than last year would be
$1,554,545 and San Rafael receives 40.54% of the net County grant (net is minus the County
overhead). This reflects the percentage of the total County population, poverty and over
crowding factors that occur in San Rafael. The estimated San Rafael grant amount is $480,214.
Of this grant amount, 15% is directed to public service projects selected by the Local Area
Committee and 85% is for housing and capital projects selected by Council. In addition, there
are two reprogramming actions that increase the Housing and Capital allocation amount. The
first is the return of $34,060 unspent funds from a 2009 allocation to Goodwill Industries and the
second is San Rafael's share of an interest payment made by Rotary valley Senior Housing on
a CDBG loan. With these adjustments, the 2011-12 allocation amounts are:

Conformance to City Priorities
The City priorities adopted in 1999 are to give primary consideration to projects which:
A. Are City of San Rafael or San Rafael Redevelopment Agency initiated or are joint
partnerships with the City or Agency
B. Fulfill the requirements of the Housing and Community Development Act of 1974 (HUD
Regulations)
C. Are affordable housing projects or community facility related activities within the San Rafael
Planning Area
D. Are projects that will move forward quickly, have the greatest impact, and can be
completed within a reasonable time frame.

A matrix evaluating the conformance of the applications with the City priorities is attached as
Exhibit 5. To qualify under priority D, a project must be a complete, distinct activity that is not
part of an ongoing maintenance program, have secure financing, reasonable site control, and
not be the first step in a multiple year planning and fundraising campaign.
Recommended Projects
Seven projects are recommended for funding in this order:
1. Public Facilities Accessibility Improvements (ADA) — City of San Rafael
2. Fair Housing Program — Fair Housing of Marin
3. Rehabilitation Loan Program — Housing Authority
4. Residential Accessibility Modifications — Marin Center for Independent Living
5. Nova Albion House — Lifehouse Inc. Roof
6. Montecillo House — Lifehouse Inc. Kitchen
7. Laurel House - Lifehouse Inc. Bedroom and Recreation room remodel
The funding requests and staff's recommendations are shown in Exhibit 6 and explained below.
In making these recommendations, staff coordinated with County staff and evaluated each
project's conformance with City priorities. First consideration was given to the City's Public
Facilities Accessibility Improvements (ADA) project. Next, the three County wide housing
projects that receive an allocation from all of the CDBG planning areas were supported. The
remaining $49,810 was then evaluated against the needs of the remaining projects.
COUNTYWIDE HOUSING PROGRAMS
Fair Housing Program $19,054
The Fair Housing Program educates landlords and neighbors about fair housing laws and helps
maintain and encourage population diversity., The program provides community education and
outreach concerning fair housing laws and services, recruits and trains fair housing testers,
monitors discrimination in the housing market, investigates and verifies claims of alleged
discrimination, counsels victims of housing discrimination and pursues fair housing cases in
court. CDBG regulations require that the City and County take affirmative action to further fair
housing; funding this program meets this obligation. The recommended funding amount was
coordinated with the County, and represents San Rafael's share of the Countywide request.
Residential Rehabilitation Loan Program $66,486
Marin County Housing Authority loans funds to low income owners of single family homes and
to non-profit operated group homes to correct substandard housing conditions and to eliminate
health and safety hazards. The recommended funding amount was coordinated with the
County and represents San Rafael's share of the Countywide request.
MCIL Housing Accessibility Modification $6,892
Through its Housing Accessibility Modification Program, the Marin Center for Independent
Living provides technical assistance and minor remodeling to make rental housing accessible to
lower income residents with impaired mobility. The recommended funding amount was
coordinated with the County and represents San Rafael's share of the Countywide allocation.
HOUSING AND CAPITAL PROJECTS
Public Facilities Accessibility Improvements (ADA) $300,000
The federal Department of Justice (DOJ) designated San Rafael a participant in their "Project
Civic Access" which requires all city facilities to come into compliance with Title II of the
American with Disabilities Act of 1990 (ADA). The City has entered into a settlement agreement
with the DOJ that requires all construction or alterations to public facilities and streets that
commenced after January 26, 1992 be made compliant with ADA requirements. The
agreement specifies revisions to public facilities such as the library, City Hall, City Plaza, parks,

parking lots and structures that must be made pursuant to a 10 year schedule (2004 to 201.4). It
is assumed that the majority of the CDBG funds will be allocated to this project for the
foreseeable future.
Nova Albion House $22,000
Nova Albion is a licensed group home for 6 adults with developmental disabilities with medical
and self care needs. The current 15 year old flat roof leaks and is not adequately insulated.
Unless the roof is secured, there will be water damage and structural damage to the facility.
Montecillo House Roof $22,000
Montecillo House is a group home for 6 men with developmental and physical disabilities. The
kitchen has never been remodeled and shows substantial wear.
Laurel House bedroom and recreation room remodel $5,810
Sunrise II is a group home for 6 persons with developmental and physical disabilities. One of
the bedrooms and the recreation room are in need of electrical wring upgrades and repair and
new sheetrock. The total amount requested is more than the funds remaining, but can cover a
significant portion of the cost.
Projects Not Recommended
Although all the proposed projects serve important needs, the available funds cannot cover all
the requests. Uniting Nationalities Institutionalized does not have adequate site control, and
has requested allocations from other Planning Areas which have not been funded. It will not
move forward in a timely manner. Marin Municipal Water District's proposal to improve water
efficiency in the homes of low income seniors is a proposal for all of their service area (most of
Marin County). It would have to be adjusted to be limited to San Rafael residents. Reductions
in utility costs is not a housing or capital project, and meets fewer of the City's priorities.
FISCAL IMPACT: There is no direct cost or revenue impact generated by the recommended
action as the City is directing HUD funds ito specific projects. Allocating funds to City projects
will allow City General Fund, capital funds and Redevelopment Agency funds to be allocated to
other projects.

Alter the housing and capital projects selected and/or the amounts allocated. The total
housing and capital allocation cannot exceed $442,242.
Allocate a smaller amount, and hold the remainder for future allocation. Any future
allocation would require action by the County Board of Supervisors, and establishing an
additional hearing date with the required noticing process could take several months.
ACTION REQUIRED: Adopt Resolution recommending Community Development Block Grant
project funding for the year 2011-12 to the Marin County Board of Supervisors.

Community Development Block Grant Program (CDBG)
PURPOSE
Under the provisions of City -County Community Development Block Grant Cooperative
Agreement approved by City Council Resolution No. 10419, the City of San Rafael has
established a City Program for CDBG funds within the San Rafael Planning Area. The City
Council has taken this action for the purposes of.
• Targeting CDBG funds to benefit San Rafael Planning Area residents;
• Coordinating CDBG project funding with other efforts of the City;
• Funding fewer projects with larger grants;
• Measuring the impact of funded projects.
PRIORITIES
In selecting projects for funding, the City Council will give primary consideration to projects
which:
A. Are City of San Rafael or San Rafael Redevelopment Agency initiated or are joint
partnerships with the City or Agency
B. Fulfill the requirements of the Housing and Community Development Act of 1974 (HUD
Regulations)
C. Are affordable housing projects or community facility related activities within the San
Rafael Planning Area
D. Are projects that will move forward quickly, have the greatest impact, and can be completed
within a reasonable timeframe.
APPLICATION PROCESS
All applications for CDBG funds shall be filed with the Marin County Community Development
Agency, Federal Grants Division, on their forms and consistent with their deadlines. Projects
requesting San Rafael Planning Area funds should indicate the; amount requested on the form.
Up to 15% of San Rafael Planning Area funds may be used for public service projects.
Applications for public service funds will be evaluated by County staff and a recommendation
made by the Local Area Committee. Applications for non public service funds will be reviewed
by City of San Rafael staff and a recommendation made by the San Rafael City Council based on
conformance with the City priorities listed above. Final action of the recommendations will be
made by the County Board of Supervisors.
TIMING
Filing deadlines for applications, with the exception of City initiated projects, will be set by the
County. The San Rafael City Council will hold a public meeting to discuss and select projects
from those submitted in the same general time frame as the Planning Area Committee meetings.
The City Council recommendation will be presented to the County Board of Supervisors as part
of the overall County CDBG processing.
