HomeMy WebLinkAboutLR Orcas Swim Club July 2020; AmendmentAMENDMENT TO AGREEMENT BETWEEN THE CITY OF SAN RAFAEL AND THE TERRA LINDA ORCAS SWIM CLUB THIS AMENDMENT to the Agreement between the City of San Rafael and the Terra Linda Orcas Swim CLUB dated June 25, 2020 (hereinafter "Amendment") is entered into this 28`h day of September 2020, by and between the CITY OF SAN RAFAEL (hereinafter "CITY"), and TERRA LINDA ORCAS SWIM CLUB (hereinafter "CLUB"). RECITALS WHEREAS, CITY and CLUB have entered into the "City of San Rafael Library and Recreation Department 2020 Agreement with Orcas Swim Club" dated June 25, 2020 (the "Agreement") pursuant to which CLUB have provided the services described in the Agreement, for a term commencing June 25, 2020 and terminating on October 1, 2020; and WHEREAS, CITY and CLUB desire to renew the Agreement for an additional six weeks, as more fully set forth below; AGREEMENT NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, CITY and CLUB hereby agree that the Agreement shall be extended beyond the term set forth in subsection A of Section 3 — Duties of City and Section 5 — Term of Agreement, for an additional six-week period from October 5, 2020 through November 12, 2020. This AMENDMENT shall include the same terms and conditions as originally set forth in the Agreement, except subsection A of Section 4 Compensation shall be repealed and replaced with the following: A. CLUB agrees to pay the CITY a fee of $43.37 per hour for two lifeguards and Terra Linda Community Pool use.
