EMERGENCY ON-CALL TREE SERVICES
THIS SECOND AMENDMENT to the Agreement by and between the CITY OF SAN
RAFAEL (hereinafter "CITY"), and TREEMASTERS TREE AND GARDEN CARE, a
corporation authorized to do business in California, (hereinafter "CONTRACTOR"), is made
and entered into as of the 30th day of June, 2021.
RECITALS
WHEREAS, the CITY and CONTRACTOR entered into an agreement dated January
26, 2019 to perform on-call emergency tree work for the CITY, for an amount not to exceed
$75,000 (the "Agreement"); and
WHEREAS, the CITY and CONTRACTOR entered into a First Amendment to the
Agreement dated February 14, 2020, to extend the term of the Agreement; and
WHEREAS, the Agreement is set to expire on June 30, 2021; and
WHEREAS, CONTRACTOR has satisfactorily performed the services called for under
the terms of the Agreement and the Parties now wish to provide for CONTRACTOR to
continue to provide the services described in the Agreement for an extended term.
AMENDMENT TO AGREEMENT
NOW, THEREFORE, the parties hereby agree to amend the Agreement as follows:
I . Section 4 of the Agreement, entitled "Time of Completion" is hereby amended to
extend the term of the Agreement through June 30, 2023.
4. Except as specifically amended herein, all of the other provisions, terms and
obligations of the Agreement between the parties shall remain valid and shall be
in full force.
IN WITNESS WHEREOF, the parties have executed this Second Amendment as of the
day, month, and year first above written.
