THE AGREEMENT FOR THE PROVISION OF AQUATIC PROGRAM SERVICES BY THE
CITY OF SAN RAFAEL TO THE CITY OF NOVATO AT THE HAMILTON POOL COMPLEX
THIS AMENDMENT to the Agreement for the Provision of Aquatic Program Services by the
City of San Rafael to the City of Novato at the Ilan iltoi P9 of Complex dated December 5, 2016 (this
"Amendment") is entered into this _ day of b1U" 2021, by and between the CITY
OF SAN RAFAEL (hereinafter "SAN RAFAEL"), and CITY OF NOVATO (hereinafter "NOVATO").
RECITALS
WHEREAS, SAN RAFAEL and NOVATO have entered into the "Agreement for the Provision
of Aquatic Program Services by the City of San Rafael to the City of Novato at the Hamilton Pool Complex"
dated December 5, 2016 (the "Agreement") pursuant to which SAN RAFAEL and NOVATO have
provided the services described in Section 3 of the Agreement, for a term commencing April 1, 2017 and
terminating on November 30, 2021; and
WHEREAS, SAN RAFAEL has updated
requests that the same fees be applied to the Har
RAFAEL's Terra Linda Community Pool; and
the Aquatics fees in its Master Fee Schedule and
ilton Pool Complex as are now adopted for SAN
WHEREAS, SAN RAFAEL and NOVATO desire to extend the Agreement for one year and that
the five-year Extension Option provided under Section 2A be preserved for exercise at the end of the one-
year extension, as more fully set forth below;
AGREEMENT
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which
is hereby acknowledged, SAN RAFAEL and NOVATO hereby agree that the Agreement shall be extended
for a one-year period from December 1, 2021 through November 30, 2022. The extension shall be on all
the same terms and conditions as originally set forth in the Agreement, with the exception of the Fee
Schedule set forth in Exhibit C, which shall be updated to the attached Exhibit D "Updated Aquatic Program
Fee Schedule."
SAN RAFAEL and NOVATO further agree to revisit the five-year Extension Option provided
under Section 2A of the Agreement no less than four (4) months prior to this extension expiration date.
IN WITNESS HEREOF, the parties hereto have executed this Amendment as of the date and year
first set forth above.
