HomeMy WebLinkAboutCD Amendment to Zoning Ordinance to Allow Animal Care Facilities as a Conditionally Permitted Use in the Office (O) Zoning District PPTAMENDMENT TO ZONING ORDINANCE TO ALLOW ANIMAL CARE FACILITIES AS A CONDITIONALLY PERMITTED USE IN THE OFFICE (O) ZONING DISTRICT SUBJECT TO PERFORMANCE STANDARDS San Rafael City Council August 1, 2022 Zoning Text Amendment –Animal Care Facilities June 28, 2022-Planning Commission considered a draft ordinance, proposed by applicant Peter Spoerl, to amend the Zoning Ordinance to allow animal care facilities in the Office (“O”) District Planning Commission unanimously recommended that the City Council adopt the Ordinance with the recommendation that Council also adopt performance standards or best practices for animal care facilities—similar to those codified for Animal Keeping to help minimize potential nuisance factors. 2San Rafael City Council August 1, 2022 Zoning Text Amendment –Animal Care Facilities •"Animal care facility" is a use providing grooming, housing, medical care, or other services to animals, including veterinary services, animal hospitals, overnight or short-term boarding ancillary to veterinary care, indoor or outdoor kennels, and similar services. -vs- •"Animal keeping" or "keeping of animals" means the ownership, possession, custody, control or sheltering of an animal for fourteen (14) or more consecutive days, by any person on private property for noncommercial purposes. (SRMC Ch.14.17.020 -Animal keeping.) 3San Rafael City Council August 1, 2022 Zoning Text Amendment –Animal Care Facilities The proposed zoning text amendment would: •allow animal care facilities in the Office District, subject to the approval of a use permit by the zoning administrator (already conditionally permitted in General Commercial and Neighborhood Commercial Districts) In response to the Planning Commission’s recommendation: •text amendment to Chapter 14.17 to include performance standards that would apply to all animal care facilities proposed within the City •a use permit approved by the zoning administrator would still be required 4San Rafael City Council August 1, 2022 Performance Standards for Animal Care Facilities 1. Compliance with Applicable Laws. The animal care facility will not violate any provision of the San Rafael Municipal Code or any other applicable provision of law. The animal care facility shall maintain an employee handbook outlining best management practices for handling of animals, handling medical waste and disposal of animal waste. 2. Sound Attenuation. The animal care facility shall not result in sound levels that exceed the noise levels established under Chapter 8.13 for any adjacent tenant spaces or properties. 3. Waste. The animal care facility shall include and maintain adequate waste and hazardous waste facilities at all times. 4. Nuisances.
