GRANT OF EASEMENT FOR STORM DRAIN
Paul M. Walker, a married man, and Damon L. Mahoney, a married man ("Grantors"), do
hereby grant to the CITY OF SAN RAFAEL, a California Charter city (the "Grantee"), for
valuable consideration, an easement over, upon, across, along, through and under the following
described strip of land situated in the City of San Rafael, County of Marin, State of California,
described as follows:
See Legal Description attached hereto as Exhibit "A".
The easement shall be held and used by the Grantee for the purposes of constructing,
installing, maintaining, repairing, reconstructing, replacing, or operating an underground public
storm drain system and related appurtenances, within the bounds of such easement, provided that
following any disturbance by Grantee of the existing ground surface, Grantee shall restore the
ground surface to its prior condition, including repair or replacement of improvements and/or
vegetation. Grantors will exercise best efforts to not obstruct Grantee's access to the easement
e.g. by planting trees or placing permanent improvements, other than retaining walls, within the
easement.
The easement also shall include the Grantee's right of ingress and egress thereto and
therefrom and upon every part thereof for all uses necessarily incident to the Grantee's use of the
easement for any of the purposes set forth above.
Grantee will provide at least 24 hours' notice to Grantor(s) for non -emergency or routine
access and time -of -entry notification for any emergency access.

EXHIBIT 'A'
STORM DRAIN EASEMENT
A portion of land lying within the City of San Rafael, County of Marin, State of California lying over and
across the Lands of Paul M. Walker, a married man, and Damon L. Mahoney, a married man, as joint tenants,
as described in that Quitclaim Deed recorded under Document Number 2013-0007137, Official Records of
Marin County, described as follows:
A strip of land, 10.00 feet wide, lying 5.00 feet on each side of the following described centerline:
BEGINNING at a point in the northerly line of Lot 13 as said lot is shown on that Map entitled 'Map of
Glenaire Subdivision, San Rafael, Calif.," filed in Book 7 of Maps at Page 39, Marin County Records, said
point lying South 70000'00" East, 0.08 feet along said northerly line of Lot 13 from the common northerly
comer of Lots 12 and 13 of said Map of Glenaire Subdivision;
Thence, leaving said northerly line of Lot 13, South 1904614" West, 56.92 feet;
Thence, South 20037'20" West, 48.09 feet to a point in the southerly line of Lot 12 of said Map of Glenaire
Subdivision, said line being coincident with the northerly line of Parcel 3 as shown on that Parcel Map
entitled "Carreras Land Division" filed in Book 9 of Parcel Maps at Page 81, Marin County Records, said
point lying North 70°00'00" West, 0.22 feet from the common southerly corner of said Lots 12 and 13;
Thence, continuing South 20037'20" West, 16.33 feet to a point on the southwesterly line of said Parcel 3,
lying South 47035'30" East, 42.84 feet along said southwesterly line from the most westerly comer thereof,
said point being the terminus of the herein described centerline.
Sidelines of said 10.00 foot strip to be prolonged or shortened to terminate at the northerly line of said Lots
12 and 13 at the north end and at the southwesterly line of said Parcel 3 at the south end.
