Streetary Program September 19, 2022 https://www.cityofsanrafael.org/ streetaries/ Slide 2 Brief Background •Outdoor dining has been a goal of the City since 2000. It started with sidewalks.(Ord. 1751) •In 2015 CC approved a 3-year pilot outdoor dining program to include parklets in street.(Reso. 13995) •In 2018 CC authorized the continuation of the on- street dining and three restaurants received approvals.(Tam Commons, Libation, and Vin Antico) •In 2020 the CC authorized an emergency measure to help businesses during COVID restrictions. Valid until November 2022. (Reso. 14809) (29 new streetaries ) •In early 2022, a 9-department team worked on guidelines with feedback from ED Subcommittee and partners such as the Chamber and BID leadership, and several local restaurants. Streetary Program September 19, 2022 https://www.cityofsanrafael.org/ streetaries/ Slide 3 Outreach •February 2022 to present:Monthly updates with Economic Development subcommittee (includes Chamber & BID leadership) •April 2022:ED subcommittee task force was created to review draft guidelines including Chamber, BID, city staff, and invited 2 streetary owners •May 2022: Staff met with a few streetary owners to review guidelines •June 21, 2022:City Council Informational Report & approved draft guidelines •July-Aug 2022: Mailed letter and emails with draft guidelines and revised program. •Aug -Sept 2022: Email, phone calls, and visited with interested streetary owners. •Sept 2022:Emailed and dropped off one-page fact sheet to highlight dates,fees, and guidelines. Streetary Program September 19, 2022 https://www.cityofsanrafael.org/ streetaries/ Slide 5 •New Ordinance under Chapter 11 (Public Works) requiring a new encroachment permit for each restaurant streetaries. –As written, equally applies to existing and proposed streetaries . •Department of Public Works authority and discretion. •The program was deemed exempt from CEQA [Sections 15304 (Class 4), 15305 (Class 5) and 15183]. •Chapter 14 (Zoning) and Downtown Precise Plan amended for consistency with the proposed Chapter 11. Streetary Program September 19, 2022 https://www.cityofsanrafael.org/ streetaries/ Slide 6 Highlights Ordinance Ordinance includes: •Required permits: Annual streetary encroachment permit –December 1, 2022 effective date of program –Building Permit and fee required if electrical and structure over 6 feet •Fees: –Permit application, –Annual Encroachment Lease Fee –Refundable one time Deposit. •Location criteria •Design and development standards •Limited to food service establishments •Operational standards: –i.e. No live entertainment without separate permit –ADA compliance mandatory •Indemnification and insurance requirements •Enforcement •Appeals process Dept of Public Works & Economic Development Dept. Ordinance includes many of the same guidelines from June 21 st City Council: Location: •Maximum 2 spaces per business •Must maintain at least 70% of parking in specified area or be near garage parking •The Ordinance will no longer allow streetaries on roads over 25mph or peak hour restrictions. –(i.e.Lincoln Avenue. Owners have been notified.) •Safety, aesthetics, and cleanliness are priorities •Traffic safety elements with wheel stops, white traffic delineators, and visible sightlines Dept of Public Works & Economic Development Dept. Streetary Program September 19, 2022 https://www.cityofsanrafael.org/ streetaries/ Slide 9 •Received feedback from 60% of 25 streetaries •Approximate level of effort to meet new guidelines: Significant = ~50% (13 locations) Moderate = ~35% (9 locations) Minimal = ~15% (3 locations) •Existing streetaries issues include: neglect, ADA non-compliance, lack of cleaning/litter, traffic safety, and aesthetic issues. •Compliance will take time and staff will work with each restaurant owner through the permitting process. Streetary Program September 19, 2022 https://www.cityofsanrafael.org/ streetaries/ Slide 10 Key Dates September 19, 2022–City Council Meeting 1st reading of proposed Ordinance October 3, 2022 –City Council Meeting 2nd (final) reading of the proposed Ordinance Review fees and guidelines as separate Resolution November 2, 2022 -Effective Date of Streetary Program. November 30, 2022 –End of the City’s prior parklet programs. Any business choosing not to participate in the new Streetary Program must remove their outdoor dining structure from public right-of-way December 1, 2022 –All businesses with an outdoor dining structure in a public parking space must have an approved Streetary Application, paid fees, and Streetary Encroachment Permit in place.
