Recommendation 1 Authorize the Community Development Director to approve alternative timing of developer payment. Recommendation 2 Recommendation 3 Adopt the same fees for Retail/restaurant/services and Hotel/motel development types as other participating jurisdictions. Maintain a higher fee for Office/R&D, in line with consultant recommendations. Modify the square footage covered by the exemption from 5,000 to 2,500 square feet. Commercial Projects 2021-23 Two projects paid commercial linkage fees: •New 5-story hotel •New assisted living development with 103 units Staff identified 11 projects <5,000 sq ft, qualifying for an exemption •For example: office expansions, new grocery market •10 projects <2,500 sq ft •Hypothetical commercial linkage fee would have made up a substantial percentage of total project fees •Combined hypothetical value of exemptions: $130,000 (~$49k/yr) The City intends to spend fee revenues on: •Permanent supportive housing or housing for very low- and/or extremely low- income households •Acquisition and/or rehabilitation of unregulated affordable housing •Publicly owned site for which the City releases a Request for Proposals for affordable housing •Shelter and navigation programs for households experiencing homelessness Commercial Linkage Fee Project List Recommended Action Introduce the ordinance amending San Rafael Municipal Code Section 14.16.030 (Affordable Housing Requirement): •Adopting a commercial linkage nexus study; •Adopting updated commercial linkage fees; and •Adopting a commercial linkage fee project list; and Waive further reading of the ordinance and refer to it by title only.
