10. CONSIDERATION OF RESOLUTION APPROVING AND AUTHORIZING THE CHAIRMAN TO

GRAND JURY REPORT ENTITLED, "THE DISABILITY RETIREMENT PROCESS: PERCEPTION

Assistant Executive Director Jim Schutz reported that on May 11, 2007, the Marin County Grand Jury
issued the report entitled: "The Disability Retirement Process: Perception and Reality" and requested
that both the City Council and Redevelopment Agency Board of Directors respond to this particular
report, which was the reason for its being on both agendas this evening and for two separate reports.
Mr. Schutz stated that overall, the Grand Jury's assessment was complimentary of the disability
retirement process. They set out to review a number of items they called "commonly held beliefs",
found the opposite on many of them, and were complimentary of the process.
In an effort to make the retirement process even more transparent and even handed, Mr. Schutz
reported that the Grand Jury made a number of findings and recommendations. The two they
requested San Rafael to respond to related to finding out the incremental cost between a disability
retirement and a normal retirement and also, administrative costs for resolving applications. They were
not asking what the numbers were, rather were suggesting that participating cities in the County find
out the incremental cost and the administrative costs for resolving the applications, and the City's
thoughts on that.
Regarding the incremental cost between a disability and normal pension, Mr. Schutz explained there
was some debate even in the Grand Jury report of whether there was a need for such a study.
Responding on behalf of the City, staff indicated that should a system -wide study be undertaken, the
City would participate in that study to some degree; therefore, if all the different member entities wanted
to put together this type of study, San Rafael would be open to participating.
As to the administrative costs, Mr. Schutz reported that staff checked with the County who indicated
that their intention was to implement this particular item beginning this fiscal year, July 1, 2007;
therefore, staff indicated San Rafael would participate as needed, although it did not appear likely they
would need assistance.
Mr. Schutz noted this item was also on the City Council agenda this evening under New Business, with
a similar report.
Member Miller moved and Member Heller seconded, to adopt the Resolution.
