HomeMy WebLinkAboutPW Proposed Urban Lot Split Ordinance PPTChapter 15.155 (Urban Lot Splits) Municipal Code Update City Council Meeting | August 19, 2024 Agenda •Background on Chapter 15.155 “Urban Lot Splits” •Why Update Chapter 15.155? •Recommendation •Public Hearing, Questions, and Discussion San Rafael Municipal Code Chapter 15.155 “Urban Lot Splits” •Contains procedures and objective development standards to implement provisions of Government Code Section 66411.7 (Urban Lot Split component of Senate Bill 9) •Added to Title 15 Subdivision via Ordinance No. 2013 on August 1, 2022 •Senate Bill 9 (SB 9) –The California HOME Act, effective January 1, 2022 Why Update Chapter 15.155 “Urban Lot Splits”? 1.Provide clarity to the two-step application process •Tentative map –approved by Community Development •Parcel map –approved by City Engineer/Public Works •Consistent with City processes for other types of minor subdivisions 2.Submit documents for City review in the proper order •Verify application meets the objective development standards prior to Applicant preparation of engineering calculations and mapping •Reduce unnecessary burden on the Applicant 3.Ensure follow-through on code compliance Recommendation Clarify and improve the procedure for City’s implementation of Government Code Section 66411.7 (SB 9) related to urban lot splits by: •Amending Chapter 15.155 (Urban Lot Splits) to add requirements for a tentative map, signed affidavits, and a restrictive covenant and agreement for the parcel map •Amending Chapter 15.03 (Minor Subdivisions) to clarify that urban lot splits applications are reviewed ministerially. •Questions/Comments? Open Public Hearing Other Proposed Changes to Ensure Code Compliance •Require the property owner to submit signed affidavits certifying that: •Owner intends to occupy one of the housing units as their principal residence for a minimum of 3 years from approval date of urban lot split •No demolition or alteration of “protected housing” will be required •Owner has not previously subdivided an adjacent parcel using an urban lot split •Require the parcel map to contain a note indicating both new parcels were created using urban lot split and that no further subdivision of the new parcels is permitted •Require the applicant to record a restrictive covenant and agreement prior to parcel recordation: •Prohibiting further subdivision of the parcel •A limitation restricting the property to residential uses only •A requirement for dwelling units on the property to be rented or leased only for periods longer than thirty days Reference Slide
