The Illicit Dumper •Transports to another location •Knows it’s illegal 2. The Casual Dumper •Sets items near their home •Follows neighborhood norms •Tenant, sub-letter, manager 90% Why are people illegally dumping? Resident Experience: •Norms and community knowledge •Lack of access to bulky item collection •Cost to dump •Transportation •Overcrowding Areas that attract dumping: •Low visibility •Perceived lack of consequences Illegal Dumping Interventions Areas of Intervention Equitable Access Active Engagement Visible Enforcement ACCESS: Bulky Waste Collection Pilots Bulky Item Drop-off Events •Centrally located •Regular schedule for easy memory •4 super-sized dumpsters every time On-site Collection Pilot •At multi-family properties •Bi-weekly on-site, no-cost pickup •Property manager participation •Saw reductions in dumping nearby Key Findings: ACCESS •Transportation is a huge barrier •On-site collection works best •Time and need varies •Lack space to store items for pickup •On-call meets needs the most •Different situations warrant different options for collection •Bulky item drop-off events warranted in Canal neighborhood ACTIVE ENGAGEMENT What was done •Bilingual presentations & surveys •Mailers & magnets to residents •Participation in community events •Hot Spot Campaigns •Data collection and analysis •Trash can placement and service Key Findings: ENGAGEMENT 1.Limited staff capacity for enforcement and outreach 2.No standardized cross- departmental coordination 3.Ongoing, consistent engagement 4.Engagement needs enforcement to nudge toward compliance 5.Good data is hard to get Enforcement What was done •Educating officers on illegal dumping enforcement/investigations •Rotating surveillance camera installations •Hot spot campaigns •Adjacent right of way pre-citations •Minimum service levels analysis •Legal / Municode analysis •Mini-grants for Crime Prevention Key Findings: ENFORCEMENT 1.Must be consistent and visible 2.Penal code and Muni code violations require different enforcement entities 3.Coordinated enforcement & engagement is necessary & effective 4.Staff capacity is limited 5.CPTED works 6.Pre -citations work for landlords The Big Takeaway Multiple, coordinated interventions are needed for success One-off interventions fail without the others Together San Rafael Proposal City of San Rafael - Illegal Dumping 2024 Final Program Recommendations •Bulky item collection at Multifamily properties like single family •Waste Management Coordinator •Robust MF outreach to change the norm and behaviors •Monthly Bulky Item Drop-off Days •Code enforcement for MF property dumping •Data collection •Mini-grants for businesses •Annual Hot Spot Campaigns •Review / Adjust Codes and Fines •Continue to apply Human Centered Design and iterate over time Bulky Waste Service Options for Multifamily •Via Marin Sanitary Service •Three options to meet different needs: •Dumpster delivery •On-call pickup •Coupon for self-haul •Property owner/manager oversees and manages 1st year •Phased roll-out over 3 years Dedicated Staffing Creates new Waste Management Coordinator position: •Administer all aspects of dumping program including engagement, code enforcement, coordination between departments and MSS •Conduct all waste management activities including illegal dumping program, SB 1383, other State regs •Consistent with other jurisdictions of San Rafael’s size and makeup Illegal Dumping Cost and Agreement Adjustment to 2025 rates: Requires amendment to Franchise Agreement with MSS to include: •Bulky item collection program •Staff position •Materials and collateral •Itemized Budget YEAR 1 2.32% YEARS 2 & 3 ~.75% Community Engagement •Canal Alliance •Canal Community Resilience Council •Community volunteers •East San Rafael Working Group •Federation of San Rafael Neighborhoods •Landlords and Apartment Managers •San Rafael Clean •Voces del Canal •Zero Waste Marin •Other organizations, churches, community groups San Rafael Case Study Other Franchise Agreement Amendments: Customer Owned Carts City Fees Marin Sanitary Service Rate Review November 4, 2024 Prohibit Customer Owned Carts •To comply with SB 1383 •Reduce injuries, route times •Customers will be offered one additional organics cart •Messaging starts January 1 •Goes into effect March 1 •All MSS jurisdictions Franchise & Other Fees Marin Sanitary Service Rate Review November 4, 2024 Fee Study Conducted & Approved in 2023 •Franchise fees may be subject to Prop 26 •Need to demonstrate reasonable charges for: •City costs (operations, staffing, etc.) •Use of City property •Vehicle impacts •Study demonstrates that City franchise fees are justified by City's costs •Amendment codifies the fees in the Study Summary & Public Hearing Marin Sanitary Service Rate Review November 4, 2024 Summary & Public Hearing City Council Recommendation Adopt a resolution: •Approving a fifth amendment to the Amendment and Restatement of Collection Agreement with Marin Sanitary Service: •Including a new Illegal Dumping Program with bulky item collection for multifamily housing, a new Waste Management Coordinator staff position, and associated items for engagement and enforcement. •Disallowing customer-owned carts/cans and increasing the number of green cans for organic materials. •Changing the method of calculating City fees based on the 2023 Fee Study. Marin Sanitary Service Rate Review November 4, 2024 Summary & Public Hearing City Council Recommendation Adopt a resolution: •Approving maximum rates collected by Marin Sanitary Service for Refuse and Recyclable Material Collection and Disposal Services, to be effective January 1, 2025, and •Setting the City’s franchise fees, cost of service fees, and vehicle impact fees to fixed amounts in the City’s Fee Study with annual adjustments based on a Consumer Price Index Maximum rates allowable would be an increase of 5.24% over 2024 rates Marin Sanitary Service Rate Review November 4, 2024
