MARIN BAY IMPROVEMENT DISTRICT NO. 1
RESOLUTION NO.
RESOLUTION ACCEPTING WORK OF IMPROVEMENT AND
AUTHORIZING SALE TO MARIN MUNICIPAL WATER DISTRICT
WHEREAS, the Council of the City of San Rafael, State
of California, heretofore by Resolution of Intention No. 2441,
adopted January 23, 1961, declared its intention pursuant to
Article 9, Chapter 2, Part 1, Division 1, Title 5 of the Govern-
ment Code of the State of California, that certain improvements
for providing electricity and electric service, gas service, tele-
phone service and water service set forth in said Resolution of
Intention and in the Engineer's Report as therein mentioned
should be sold without calling or advertising for bids as therein
stated; and
WHEREAS, the Council of the City of San Rafael heretofore
by Resolution No. 2455, adopted February 27, 1961, authorized
the sale to Marin Municipal Water District, without calling or
advertising for bids for the sum of One Dollar ($1.00) in lawful
money of the United States of America, a system of domestic water
supply including transmission lines distribution system, pressure
system, pipes, valves, connections and other facilities as more
particularly referred to in said Resolution No. 2441; and
WHEREAS, Underground Construction Co., Inc. of Oakland,
California was awarded a contract for the installation of said
facilities by resolution duly adopted by the Council of the City
of San Rafael on April 17, 1961, and
WHEREAS, the Board of Directors of Marin Mudcipal Water
District, the City Engineer of the City of San Rafael and the
Engineer of Work have duly indicated their acceptance of the
work called for to be done and performed; and

WHEREAS, Underground Construction Company, Inc. has
filed with the Engineer of Work a maintenance bond for twenty
five percent (25%) of the sum of its contract naming the City
of San Rafael and Marin Municipal Water District as co -obligees;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF SAN RAFAEL, STATE OF CALIFORNIA, as follows:
1. The work of improvement installed and supplied by
Underground Construction Co., Inc. of Oakland, California, as
aforesaid, is hereby accepted.
2. The Mayor and the City Clerk of the City of San
Rafael are hereby authorized and empowered to execute for and
on behalf of the City of San Rafael a bill of sale transferring
to Marin Municipal Water District for the consideration of One
Dollar ($1.00) in lawful money of the United States of America
the water distribution system more particularly referred to by
Resolution No. 2464 adopted May 20, 1961 by the City Council of
the City of San Rafael.

and the same is now in full force and effect.
