RESOLUTION AND ORDER ADOPTING ENGINEERS REPORT AND
ORDERING THE ACQUISITION OF IMPROVEMENTS, WHITE OAKS
UNIT TWO ASSESSMENT DISTRICT, CITY OF SAN RAFAEL,
MARIN COUNTY, CALIFORNIA.
WHEREAS, on the 2nd day of October, 1961, the City Council
of the City of San Rafael,'Marin County, State of California, adopted
its Resolution of Intention No..)_,( 3 b for the acquisition of certain
public improvements in White Oaks Unit Two Assessment District, San
Rafael, Marin County, California, and referred said acquisition of
improvements to GEORGE S. NOLTE, Engineer of Work for said assess-
ment district; and
WHEREAS, said City Council directed said Engineer of Work
to make and file with the City Clerk of the City of San Rafael a
report in writing in accordance with the provisions and requirements
of the Municipal Improvement Act of 1913 of the State of California;
and
WHEREAS, said GEORGE S. NOLTE, on the 2nd day of October,
19611, filed with the City Clerk of the City of San Rafael his.report
in accordance with the said resolution, and said City Clerk has pre-
sented said report to this City Council for consideration;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of San Rafael, and this City Council hereby finds:
A. That the report made and filed by GEORGE S. NOLTE on
the 2nd day of October, 1961, contains all of the requirements
provided for said report by the provisions of the Municipal Improve-
ment Act of 1913, including (1) specifications; (2) plans and profiles
and estimate of cost; (3) assessment diagram and assessment; (4) de-
scription of easements or rights of way to be acquired.
B. That said report, and each and every part thereof,
is sufficient in every particular and it is hereby determined that

such report shall stand as the report for all subsequent proceedings
under said Municipal Improvement Act of 1913; and
BE IT FURTHER RESOLVED that Monday, the (,;p day of
ur ►,,, 1961, at the hour of IU1) o' clock P.M. of said day,
at the meeting place of the City Council of the City of San Rafael,
located in the City Hall, Fifth and "A97 Streets, San Rafael, California,
is hereby fixed by this -City Council as the time for hearing protests
with relation to the proposed acquisitions described in said report;
that any person interested in objecting to said improvements, the
grades to which the work will be done or has been done, the extent
of the assessment district, the assessment or the Engineer's estimate
of cost and expenses, or any other act or determination of the
Engineer of Work or the City Council of the City of San Rafael, may
file protest in writing with the City Clerk of the City of San Rafael
at or before the hour fixed herein for hearing thereon; and
BE IT FURTHER RESOLVED, and this City Council hereby finds,
that the owners of one hundred per cent (100%) of the area of the
property within the boundaries of the district proposed to be assessed
have filed with this City Council waivers waiving (1) any posting of
any notice of hearing; (2) any mailing of any notice of hearing; and
(3) any publication of any notice of hearing, all as required by the
provisions of the Municipal Improvement Act of 1913; that notwith-
standing said waiver, this City Council hereby determines and orders
that the City Clerk of the City of San Rafael shall publish twice in
the INDEPENDENT JOURNAL a Notice of Improvement, giving notice of the
time and place of hearing on said assessment and report, as hereinabove
described, the first of which said publications shall be at least
ten (10) days prior to the date fixed herein for hearing; and
BE IT FURTHER RESOLVED that this City Council hereby
orders that the acquisitions described in said Resolution of Intention

be had and made in accordance with said Resolution of Intention and
in accordance with the plans and profiles and specifications on file
for said improvements and heretofore approved by this City Council
and the City Engineer of the City of San Rafael.
I HEREBY CERTIFY that the foregoing Resolution was duly
and regularly adopted by the City Council of the City of San Rafael,
California, at a regular meeting thereof, held on the 2nd day of
October, 1961, by the following vote, to wit:
