MAKING CERTAIN GUARANTEES TO THE UNITED
STATES OF AMERICA.
RESOLVED by the City Council of the City of San Rafael, Marin County,
California, that
WHEREAS, in the River and Harbor Act of Congress approved the 2nd day
of March, 1919, provision was made for the improvement of San Rafael Creek,
as described in House Document 801, Sixty -Third Congress, Second Session; and
WHEREAS, the public interest and welfare will be served thereby.
NOW, THEREFORE, BE IT RESOLVED that this Council does hereby declare
that it will cooperate in every legal manner possible with the following
conditions:
(a) Furnish free of cost to the United States adequate dumping grounds
together with the necessary levees as may be necessary for the disposal of
spoils dredged in maintaining the improvement; and
(b) Hold and save harmless the United States of America free from
claims for damage resulting from the improvement and maintenance of the project,
save and except those damages which result from negligence in the performance
of said work of improvement and maintenance.
