HomeMy WebLinkAboutCC Resolution 2557e RESOLUTION NO. `5 S7 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF SAN RAFAEL OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "SAN PEDRO SCHOOL ANNEXATION," AND GIVING NOTICE OF TIME AND PLAC. FOR HEARING OF PROTESTS THERETO. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN RAFAEL: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of not less than one-fourth of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of Marin, was filed with the Council of the City of San Rafael on�'1ti— , 1962, requesting annexation of the hereinafter describe territ ry to said City. 2. That the territory which the petitioners request be annexed to the City of San Rafael and which said City -and its Council propose to annex, is situate in the County of Marin, State of California, hereby designated "SAN PEDRO SCHOOL ANNEXATION," and described as follows: Beginning at a point on the Northeasterly line of San Pedro Road, said point bearing N 550071W 100.00 feet and N 340531E 60.00 feet from the most Easterly corner of Lot 132, Block 10, as shown upon that certain map entitled, "Map of Uplands, Beauti- ful Villa Sites overlooking San Francisco Bay, near San Rafael, Cal.", filed November 202 1908 in Book 3 of Maps, at Page 4, Marin County Records; thence along said Northeasterly line of San Pedro Road and along the Corporate Limit Line of the City of San Rafael N 55°07'W 822.59 feet and S 820111W 163.33 feet; thence leaving said Northeasterly line and Corporate Limit Line S 70491E 60.00 feet to the most Northeasterly corner of Lot 114 as shown on said map; thence S 270411W 164.85 feet and S 1035' E 84.75 fleet to a point on the Easterly line of Hillside Avenue as shown on said map, said point bearing S 190021E 37.92 feet from the most Southerly corner of said Lot 114; thence Southeasterly along the Northeasterly line of said Hillside Avenue to a point thereon which bears S 34053'W from the point of beginning; thence leaving said Northeasterly line of said Hillside Avenue N 340531E 505 fs-_'t, more or less, to the point of beginning. 3. That the County Boundary Commission of Marin County, California, did in session duly assembled on Monday, October 16th, 1961, consic'or the proposed annexation boundaries of said "SAN PEDRO SCHOOL ANNEXATION," as above described, and as submitted to said Commission by the proponents of said annexation. I 4. That if said territory is annexed it shall become part of the school district of the City of San Rafael. File Pio. __ S-_- .- 34 Council Meeting .......................................... Disposition 5. That �"^- 1962, at the hour of Y�0C&e_-A in the ouncil Chambers in the City Hall in the City of San Rafael, County of Marin, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of San Raf.:ael, and having any objections to the proposed annexation, may appear before the Council of the City of San Rafael and show cause why such uninhabited territory should not be so annexed to the City of San Rafael. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general temms. 6. The City Clerk of the City of San Rafael is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Independent -Journal, a newspaper of general circulation published in said City of San Rafael, the city to which it is proposed to annex the aforesaid territory, said publication to be complete at least twenty (20) days prior to the date set for hearing. 7. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. I, W. L.
