HomeMy WebLinkAboutCC Resolution 2560RESOLUTION NOV.-,9-5� D RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF SAN RAFAEL OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "ENEMARK ANNEXATION," AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN RAFAEL: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of not less than one-fourth of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of Marin was filed with the Council of the City of San Rafael oni,,L� / S 196._, requesting annexation of the hereinafter described territory of said City. 2. That the territory which the petitioners request be annexed to the City of San Rafael and which said City and its Council propose to annex, is situate in the County of Marin, State of California, hereby designated "ENEMARK ANNEXATION," as described in Exhibit "A" attached hereto and made a part hereof. 3. That the County Boundary Commission of Marin County, California, did in session duly assembled on , .�fi »��� ll , 196, consider the proposed annexation boundaries of said "ENEMARK ANNEXATION," as above described, and as submitted to said'Commission by the proponents of said annexation. 4. That 99 , l'i�l� `�� 196_, at the hour of �� �'�' /Y% , in the Cou nc i 1 Chambers in the City Hal l in the City of San Rafael, County of Marin, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of San Rafael, and having any objections to the proposed annexation, may appear before the Council of the City of San Rafael and show cause why such uninhabited territory should not be so annexed to the City of San Rafael. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of San Rafael is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Independent -Journal, a newspaper of general circulation published in said City of San Rafael, the city to which it is proppsed to annex the aforesaid territory, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. I, W. Subdivision No. 2" recorded November 29, 1911 in Liber 4 of Maps at Page 61, Records of Marin County, California. Said point of beginning being the inter- section of the two courses S 700 30' W, 236.31 feet; and N 870 07' W, 99.23 feet; as they are described in San Rafael Charter Ordinance No. 620 entitled "An Ordinance Approving the Annexation of Certain Uninhabited Territory Desig- nated, McNear Ranch, to the City of San Rafael". Thence leaving said point of beginning S 610 14' E, 26.84 feet; to the southerly line of the afore - described Ridge Avenue; thence leaving said southerly line and along the westerly line of Lot 6 as shown on said map S 500 24' E, 524.1 feet, to the northerly line of Bayview Drive as said street is shown on that certain map entitled "Map of Bayside Acres, Marin County, Cal. Subdivision No. 2" above referred to; thence along the northerly line of said Bayview Drive the follow- ing courses and distances N 620 25' E, 72.23 feet; S 630 E, 111.57 feet; S 670 26' E, 98.18 feet; S 71' 19' E, 47.65 feet; S 770 43' E, 46.41 feet; and S 870 44' E, 47.68 feet; thence leaving said northerly line of Bayview Drive along the easterly line of Lot 5 as shown on said map N 5' 49' W, 451.2 feet, to the southerly line of the aforementioned Ridge Avenue, thence leaving said southerly line N 220 53' W, 20 feet to the center line of said Ridge Avenue said center line being the corporate limits of the City of San Rafael as described in Charter Ordinance No. 620 before referred to, thence along the corporate limits S 660 08' W, 123.40 feet; S 850 37' W, 88.95 feet; N 75° 56' W, 133.24 feet; N 700 04' W, 227.37 feet; and S 700 30' W, 236.31 feet to the point of beginning. Containing 5.47 acres more or less.
