RESOLUTION OF PRELIMINARY DETERMINATION THAT THE
PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE CON-
STRUCTION AND ACQUISITION OF IMPROVEMENTS IN BRET
HARTE DRAINAGE ASSESSMENT DISTRICT, CITY OF SAN
RAFAEL. MARIN COUNTY, CALIFORNIA
BE IT RESOLVED by the City Council of the City of San
Rafael, Marin County, California, as follows:
1. Preliminary determination is hereby made that the
public convenience and necessity require that the following im-
provements be made and paid for by special assessments levied upon
the property benefited, and that necessary special assessment pro-
ceedings should be taken therefor.
2. The nature of the proposed improvements consists of
certain grading and the construction of storm sewers, catch basins,
manholes, junction boxes, outlet structures, dikes, channels, reten-
tion basins, the reconstruction of pavement, sidewalks, curbs and
gutters, the relocation and/or reconstruction of certain existing
underground storm and sanitary sewers, gas lines and water lines.
It shall further include the acquisition of certain real property,
easements and rights of way, together with all appurtenances there-
to.
3. The public interest and convenience will be served by
the taking of special assessment proceedings for the construction of
the improvements set forth in this resolution. Said work is of more
than ordinary public benefit and the cost and expenses thereof should
be borne by a district benefited by said construction of improvements.
Said district shall be known and designated as "Bret Harte Drainage
Assessment District, City of San Rafael, Marin County, California".
4. The district which shall bear the cost and expenses of
said construction of improvements, including all incidental expenses,
and which is to be assessed to pay for the cost of said improvements,
is that district shown on a map which is on file in the office of the
City Clerk of the City of San Rafael, which is designated,"Map
Showing Boundaries of District Proposed to be Assessed for Improve-
ments to be made in Bret Harte Drainage Assessment District, City of
San Rafael, County of Marin, State of California".
5. That DAN COLEMAN ASSOCIATES shall be Engineer of Work
in accordance with agreement to be hereafter entered into between
the said DAN COLEMAN ASSOCIATES and the City of San Rafael.
6. That the firm of STURGIS, DEN-DULK, DOUGLASS & ANDERSON
shall be Special Bond Counsel to prepare all proceedings in accordance
with agreement to be hereafter entered into between the said STURGIS,
DEN-DULK, DOUGLASS & ANDERSON and the City of San Rafael.
7. That said district hereinabove referred to shall be
formed under the provisions of the Municipal Improvement Act of 1913,
with bonds to be issued under the provisions of the Improvement Act
of 1911.
I HEREBY CERTIFY that the foregoing Resolution was duly and
regularly adopted by the City Council of the City of San Rafael, Nlarin
County, California, at a regular meeting thereof, held on the 19th
day of March, 1962, by the following vote, to wit:
